RESOLUTION
Urging the division of boating and OCEAN recreation to adhere to the state auditor's recommendations.
WHEREAS, the Auditor has repeatedly indicated serious flaws in the management of the boating program; and
WHEREAS, among the flaws, the Auditor cites ineffective financial controls, incomprehensible rules, and absence of a statewide plan; and
WHEREAS, the Auditor's report has made several recommendations to improve the Division of Boating and Ocean Recreation's administration of the boating program; and
WHEREAS, the Board of Land and Natural Resources stated in a December 2001 meeting that the Division of Boating and Ocean Recreation will hold public hearings before any boating fee increase; and
WHEREAS, there is no specific definition of "privatization" as applied to privatization of facilities and services; now therefore,
BE IT RESOLVED by the Senate of the Twenty-First Legislature of the State of Hawaii, Regular Session of 2002, the House of Representatives concurring, that the Division of Boating and Ocean Recreation is requested to implement all of the Auditor's recommendations as outlined in the past three audit reports; and
BE IT FURTHER RESOLVED that the Division of Boating and Ocean Recreation hold a public hearing to obtain input to contribute towards establishing a statewide management plan for boating; and
BE IT FURTHER RESOLVED that no privatization should be implemented by the Division of Boating and Ocean Recreation, as recommended by the auditor; and
BE IT FURTHER RESOLVED that the Division shall specifically define "privatization" and submit legislation clarifying the "privatization of small boat harbors"; and
BE IT FURTHER RESOLVED that the Board of Land and Natural Resources shall conduct public hearings jointly with the Senate Committee on Economic Development and Technology and House Committee on Economic Development and Business Concerns to investigate the Division's practices; and
BE IT FURTHER RESOLVED that there shall be a freeze on increases of boating fees until completion of the joint investigation; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the President of the Senate, the Speaker of the House of Representatives, the Chair of the Senate Committee on Economic Development and Technology, the Chair of the House Committee on Development and Business Concerns, the Director of the Division of Boating and Ocean Recreation, the Chairperson of the Department of Land and Natural Resources, and the Auditor.
