SENATE CONCURRENT

RESOLUTION

 

REQUESTING A STUDY regarding THE regulation of PRESCRIPTIVE AUTHORITY FOR ADVANCED PRACTICE REGISTERED NURSES.

 

WHEREAS, pursuant to section 457-5, Hawaii Revised Statutes (HRS), regulation of the nursing profession in Hawaii falls under the jurisdiction of the Board of Nursing; and

WHEREAS, however, under section 457-8.6, HRS, the Department of Commerce and Consumer Affairs (DCCA) is designated as the agency that grants prescriptive authority to advanced practice registered nurses (APRNs) and the Board of Medical Examiners (BME) is the agency directed to designate the applicable formularies for APRNs; and

WHEREAS, Hawaii is the only state in which three separate entities regulate the nursing profession; and

WHEREAS, in the majority of states, prescriptive authority for APRNs is granted by the state board of nursing; and

WHEREAS, S.B. No. 2129 (2002) amends section 457-8.6, HRS, by requiring the Board of Nursing, rather than the DCCA, to grant APRNs prescriptive authority, directs the Board of Nursing, rather than the BME to designate APRN formularies, requires the Board of Nursing to establish requirements for APRN prescriptive authority, and establishes an advisory committee comprised of APRNs, doctors who work with APRNs, pharmacists, and other health professionals to advise the Board of Nursing on formulary matters; and

WHEREAS, prior to enacting the abovementioned amendments, the legislature should further study the issues raised therein; now, therefore,

BE IT RESOLVED by the Senate of the Twenty-First Legislature of the State of Hawaii, Regular Session of 2002, the House of Representatives concurring, that the Legislative Reference Bureau is requested to study the issue of the regulation of prescriptive authority for APRNs, including the manner in which it is implemented in other states, review the arguments for and against adopting the regulatory scheme proposed under S.B. No. 2129, and make recommendations regarding the appropriate regulatory framework for APRN prescriptive authority; and

BE IT FURTHER RESOLVED that the Legislative Reference Bureau is requested to submit its findings and recommendations to the Legislature no later than twenty days before the convening of the Regular Session of 2003; and

BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Director of the Legislative Reference Bureau, the Director of Commerce and Consumer Affairs, the Chairperson of the Board of Nursing, and the Chairperson of the Board of Medical Examiners.
