A BILL FOR AN ACT
relating to state small boat harbors.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that many of the existing state small boat harbors are in poor condition, deteriorated, do not meet current code requirements such as those for the Americans with Disabilities Act, create an unreasonable exposure to potential liability claims due to the deteriorated condition of the facilities, and do not provide the types of support facilities necessary for an expanded recreational boating industry and commercial support activities.
The legislature further finds that private development and management of harbor facilities on state lands could result in significant increases in recreational boating opportunities for the residents of Hawaii, increased tourism in the areas of recreational boating, yacht rentals, and other demands for recreational boating activities throughout the State.
In addition, the legislature finds that private development and management of harbor facilities on state lands could result in positive impacts for all recreational boating facilities and communities throughout the State through increased demand for commercia1, recreational, and tourism activities and opportunities at all state recreational boating facilities, whether privately developed and managed or managed by the State.
The purpose of this Act is to require the department of land and natural resources to enter into a contract with a private company to evaluate conditions of existing boating facilities throughout the State in order to determine the types and extent of repairs and improvements necessary to adequately support the increase in recreational boating activities, commercial activities, and tourism, which could result from the private development and management of harbor facilities on state land; and to develop a master plan for improvements that will support the increased recreational boating activities and programs throughout the State.
SECTION 2. The department of land and natural resources shall enter into a contract with a private consulting firm with experience in feasibility studies and design of recreational boating facilities.
The private consulting firm shall undertake the following study and provide a report addressing:
(1) A condition assessment of the existing state small boat harbors;
(2) Recommended improvements to existing state small boat harbors in order to support the increased demand for recreational boating activities and commercial activities at all state small boat harbors, as a result of private development and management of some harbors on state lands;
(3) An evaluation of costs for recommended improvements to state small boat harbors in order to correct existing deficiencies, meet changed code requirements, reduce state liability exposure for deteriorated facilities and code requirements, and provide the necessary facilities and commercial activities to support an expanded recreational boating industry in the State;
(4) An evaluation of funding sources for recommended improvements to enhance the state small boat harbors and the recreational boating industry in the State, including expanded private development and management of state harbor facilities; and
(5) Development and presentation of a master plan for improvement of the state small boat harbors, which will enhance recreational boating activities throughout the State, reduce state costs for capital and maintenance expenditures of existing facilities, enhance commercial activities and opportunities in support of recreational boating activities, and enhance the recreational boating industry in Hawaii.
SECTION 3. The department of land and natural resources shall submit the consultant's study and report to the legislature no later than twenty days prior to the convening of the regular session of 2003.
SECTION 4. This Act shall take effect upon its approval.
