A BILL FOR AN ACT
relating to special education.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that the recruitment and retention of special education teachers in the public schools of Hawaii has been difficult due to the unique demands put upon them, especially in light of the Felix Consent Decree. For example, they are expected to take a key role in case management in addition to their teaching duties. The legislature further finds that there needs to be reassignment of educational assistants within each school so that there will be one full-time educational assistant for every special education teacher. If the reassignment does not fulfill the mandate to provide this one-to-one ratio, then the public school shall hire the necessary amount of educational assistants to achieve the require staffing ratio.
SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $ , or so much thereof as may be necessary for fiscal year 2002-2003, for the purpose of hiring educational assistants.
SECTION 3. The sum appropriated shall be expended by the department of education for the purposes of this Act.
SECTION 4. This Act shall take effect on July 1, 2002.
