A BILL FOR AN ACT

 

relating to volunteer legal services hawaii.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that the events of September 11, 2001, have had serious and detrimental impacts on Hawaii's economy, resulting in, among other things, worker lay-offs, bankruptcies, and businesses leaving Hawaii's market. The detrimental impacts on Hawaii's economy have placed greater strain on families and increased the number of reported cases of domestic violence, child abuse, and crime. These problems have led to a growing number of Hawaii's families who rely on both public-sector and private-sector social services to address their immediate needs.

Volunteer Legal Services Hawaii was established in 1981 to provide volunteer legal services to those who are unable to afford legal services. Among other things, Volunteer Legal Services Hawaii sponsors community-based projects that further assist Hawaii's indigent populations in obtaining much needed legal services, including:

(1) The gap group project;

(2) The housing support legal project;

(3) Na keiki law center;

(4) Neighborhood legal clinics;

(5) Organizational legal assistance;

(6) Student advocates for victims of domestic violence; and

(7) Telephone information and referral.

Currently, Volunteer Legal Services Hawaii is renting, on a month-to-month basis, the second floor of the American Brewery building, located at 545 Queen Street. The American Brewery building is owned and managed by the Hawaii community development authority for use as an incubator to assist the development of nonprofit organizations. The Hawaii community development authority has utilized the American Brewery building to house various private, nonprofit organizations that provide health and human services to Hawaii's citizenry.

The legislature further finds that, because of perceived problems with the building, such as unusual smells, all the tenants, with the exception of Volunteer Legal Services Hawaii, have left the building. Volunteer Legal Services Hawaii has offered to purchase the building from the Hawaii community development authority. Negotiations on the sale of the American Brewery building have stalled.

The legislature declares that the sale of the American Brewery building to Volunteer Legal Services Hawaii serves a public interest by assisting private, nonprofit organizations to continue to provide affordable and accessible health and human services to the people of our State.

The purpose of this Act is to direct the Hawaii community development authority to sell the land and improvements thereon situated at 545 Queen Street, also known as the American Brewery building, TMK 2-1-31:21, to Volunteer Legal Services Hawaii.

SECTION 2. The Hawaii community development authority shall enter into negotiations with Volunteer Legal Services Hawaii for the sale of the American Brewery building, TMK 2-1-31:21. Not later than one year after the effective date of this Act, the Hawaii community development authority shall execute instruments of conveyance as may be necessary and proper to convey full title to these lands and improvements in fee simple, in consideration of which Volunteer Legal Services Hawaii shall pay just compensation to the grantors at fair market value.

SECTION 3. The executive director of the Hawaii community development authority shall submit a status report to the legislature no later than twenty days prior to the convening of the regular session of 2003 that shall include:

(1) Actions taken pursuant to this Act; and

(2) Recommendations for further legislative action.

SECTION 4. This Act shall take effect upon its approval.
