A BILL FOR AN ACT
RELATING TO HYPNOTHERAPISTS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The Hawaii Revised Statutes is amended by adding a new chapter to be appropriately designated and to read as follows:
"Chapter
HYPNOTHERAPY
§ -1 Practice of hypnotherapy; qualifications. No person shall represent, advertise, or announce oneself, either publicly or privately, as an hypnotherapist, nor use, in connection with the person's name or place of business, the word "hypnotherapist", "certification in clinical hypnosis" or "approved consultant in clinical hypnosis" or any other words, letters, abbreviations, or insignia indicating or implying that the person is a hypnotherapist unless the person meets the qualifications in section -2.
§ -2 Qualifications and requirements of hypnotherapist. For a hypnotherapist to practice in the State of Hawaii, an individual shall:
(1) Complete the requirements and obtained certification through the American Society of Clinical Hypnosis with either the entry level "certification" or the advanced level "approved consultant" certification; and
(2) Obtain and maintain malpractice insurance.
§ -3 Injunction. The director of the office of consumer protection may bring a proceeding to enjoin an violation of this chapter.
§ -4 Civil penalty. Any person violating any provisions of the chapter shall be fined a sum of not less that $500 nor more than $10,000 for each violation, which shall be collected in a civil action bought by the director of the office of consumer protection."
SECTION 2. This Act shall take effect upon approval.
