Description:
Provides that no speeding conviction initiated by a photo speed imaging detector system shall appear on a person's record. Exempts person from speed laws if consecutive speed limit signs differ by 20 or more mph and the person is traveling within the 1st 100 yards after 2nd sign at less than 10 miles over speed limit.

A BILL FOR AN ACT
relating to traffic ENFORCEMENT.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Act 234, Session Laws of Hawaii 1998, as amended by Act 263, Session Laws of Hawaii 1999, as amended by Act 240, Session Laws of Hawaii 2000, is amended by amending section 15 to read as follows:
"SECTION 15. Penalty. The penalties for all consequences of a violation for speeding initiated by the use of a photo speed imaging detector system, for disregarding a steady red signal initiated by the use of a photo red light imaging system, or for illegally crossing longitudinal traffic lane markings initiated by the use of a photo technology system shall be as provided in section 291C-161, Hawaii Revised Statutes[.]; provided that notwithstanding section 286-137 or any other provision of law to the contrary, no conviction for a violation of speeding initiated by the use of a photo speed imaging detector system under this part shall appear on a person's traffic record."
SECTION 2. Section 291C-102, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:
"(a) No person shall drive a vehicle at a speed greater than a maximum speed limit, and no person shall drive a motor vehicle at a speed less than a minimum speed limit established by county ordinance[.]; provided that no person shall be deemed in violation of this section if the speed limit between two consecutive speed limit signs decreases by twenty miles per hour or more and the person was traveling within the first one hundred yards after the second sign at a speed of ten miles per hour or less over the posted speed limit."
SECTION 3. This Act shall apply to any conviction for a violation of speeding initiated by the use of a photo speed imaging detector system that occurs prior to its effective date.
SECTION 4. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 5. This Act shall take effect upon its approval.
