A BILL FOR AN ACT

 

relating to parking structures.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that residents living in close proximity to parking structures are subjected to noise from squealing tires and car alarms, dust and exhaust fumes, and the glare of vehicle headlights due to the constant ingress and egress of motor vehicles. These conditions create stress for area residents and adversely impact upon their quality of life.

The purpose of this Act is to minimize the unhealthy and stressful conditions caused by motor vehicle parking by requiring that parking structures near residential areas be enclosed and by establishing a permissible level of noise emission for parking structures.

SECTION 2. Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§46- Parking structures; enclosure required; noise restriction; definitions. (a) Each county shall adopt ordinances:

(1) Requiring the enclosure of all existing and future commercial parking structures situated within one thousand feet of a residentially zoned area, with the location of ventilation systems and ducts subject to the approval of county building officials and located so as to reduce air pollution impacts and noise impacts on adjacent residential areas to a minimum; and

(2) Prohibiting noise levels exceeding twenty decibels at any time in parking structures situated within one thousand feet of a residentially zoned area.

(b) As used in this section:

"Enclosure" means the act of closing in with a solid roof and solid walls on all sides, with openings for ingress and egress.

"Parking structure" means a multi-level structure all or part of which is used or intended to be used to provide space for the parking of motor vehicles for private purposes or is available to the public, and shall include parking spaces, loading spaces, maneuvering aisles, and other areas providing access to parking or loading spaces."

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval; provided that parking structures existing on the date of approval of this Act shall comply with this Act by July 1, 2003.
