A BILL FOR AN ACT
proposing an amendment to article vii of the hawaii constitution, to require that collective bargaining salary increases and other cost items be automatically funded upon ratification of the collective bargaining agreement.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The purpose of this Act is to propose an amendment to Article VII of the Constitution of the State of Hawaii to require that public employee collective bargaining salary increases and other cost items be automatically funded upon the ratification of the collective bargaining agreement.
SECTION 2. Article VII of Constitution of the State of Hawaii, is amended by adding a new section to read as follows:
"FUNDING FOR PUBLIC EMPLOYEE COLLECTIVE BARGAINING SALARY INCREASES
Section 14. Whenever a public employee collective bargaining agreement containing salary increases and other cost items is ratified, the appropriate legislative body shall provide adequate funding to fully cover the salary increases and cost items contained in the collective bargaining agreement for the entire term of the agreement."
SECTION 3. The question to be printed on the ballot shall be as follows:
"Shall public sector collective bargaining agreement cost items be automatically funded by the appropriate legislative body upon the ratification of the collective bargaining agreement?"
SECTION 4. New constitutional material is underscored.
SECTION 5. This amendment shall take effect upon compliance with Article XVII, section 3, of the Constitution of the State of Hawaii.
