STATE OF HAWAII

A BILL FOR AN ACT

 

relating to the natural energy laboratory of hawaii authority.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 227D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§227D-    Confidentiality of trade secrets or the like; disclosure of financial information. (a) Notwithstanding chapters 92, 92F, or any other law to the contrary, any documents or data made or received by any member or employee of the authority shall not be a public record to the extent that the material or data:

(1) Consists of trade secrets;

(2) Consists of commercial or financial information regarding the operation of any business conducted by an applicant for, or recipient of, any form of assistance that the authority is empowered to render; or

(3) Relates to the competitive position of that applicant in a particular field of endeavor.

(b) Any discussion or consideration of trade secrets or commercial or financial information shall be held by the board, or the subcommittee of the board, in executive session closed to the public; provided that:

(1) The purpose of any such executive session shall be set forth in the official minutes of the authority; and

(2) Business that is not related to that purpose shall not be transacted nor shall any vote be taken during the executive session."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
