A BILL FOR AN ACT
relating to education.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. (a) Subject to the availability of funds appropriated under section 2, the department of education shall provide an incentive bonus equal to ten per cent of any nonstate grant or subsidy that is awarded to a school or school teacher on a competitive basis; provided that:
(1) Not more than $25,000 may be credited to any one elementary, middle, or high school per fiscal year; and
(2) Not more than $37,500 may be credited to any one multi-level (high/elementary, middle/elementary, or high/middle) school per fiscal year.
(b) The incentive bonus established under subsection (a) shall be credited to a school's account not more than thirty days after the school is officially notified that it has been awarded the nonstate grant or subsidy. The incentive bonus shall be used for the purposes identified in the nonstate grant or subsidy. In the event of a conflict between this Act and section 302A-1184, Hawaii Revised Statutes, this Act shall control.
(c) This Act shall not apply to:
(1) New century charter schools chartered and regulated by the board of education; and
(2) District and state offices of the department of education.
SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $500,000, or so much thereof as may be necessary for fiscal year 2002-2003, to carry out the purposes of this Act. The sum appropriated shall be expended by the department of education.
SECTION 3. This Act shall take effect on July 1, 2002.
