A BILL FOR AN ACT

 

Relating to education.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 302A-1143, Hawaii Revised Statutes, is amended to read as follows:

"[[]§302A-1143[]] Attend school in what district. (a) All persons of school age shall be required to attend the school of the district in which they reside, unless it appears to the department to be desirable to allow the attendance of pupils at a school in some other district, in which case the department may grant this permission.

(b) Priority consideration to allow the attendance of pupils at a school in some other district shall be granted only to:

(1) Adopted or foster children who would benefit from the continuation of education or education-related services, or both, in the school complex where the children are currently enrolled;

(2) Children of grandparents who both:

(A) Reside in the receiving school's geographic attendance area; and

(B) Provide either before-school or after-school care for the children; and

(3) Children of full-time staff who work within the school complex that contains the receiving school.

The reasons for priority consideration are not ranked and each shall be given equal consideration. All other requests to attend a school in some other district shall be considered only after priority requests have been accommodated.

(c) For the purposes of this section:

"Home school" means the school within the geographic attendance area that the student shall attend according to the student's legal residence.

"Receiving school" means the school outside the geographic area of the student's legal residence."

SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
