HOUSE CONCURRENT

RESOLUTION

 

requesting the auditor to conduct a sunrise review of the regulation of hypnotherapists.

 

 

WHEREAS, the Legislature finds that there is a need to regulate hypnotherapists by requiring licensure; and

WHEREAS, House Bill No. 2634 was introduced during the Regular Session of 2002 to regulate hypnotherapists; and

WHEREAS, section 26H-6, Hawaii Revised Statutes, requires the Legislature, by concurrent resolution, to refer to the Auditor a request for analysis of any new regulatory measure being considered for enactment that, if passed, would subject unregulated professions and vocations to licensing or other regulatory controls; and

WHEREAS, if regulated, hypnotherapists would need to meet certain educational, examination, and experience requirements; and

WHEREAS, in their work, hypnotherapists affect the emotional, mental, psychological, and economic well-being of individuals and families; and

WHEREAS, other professionals in related fields, such as psychologists, social workers, case managers, psychiatrists, nurses, members of the clergy, school counselors, and others may be affected; and

WHEREAS, the consuming public at large may also be affected if the costs of seeking hypnotherapeutic treatment increase because of licensure and regulation; now, therefore,

BE IT RESOLVED by the House of Representatives of the Twenty-first Legislature of the State of Hawaii, Regular Session of 2002, the Senate concurring, that the Auditor is requested to perform a sunrise review of the regulation of hypnotherapists as provided for in House Bill No. 2634, as introduced during the Regular Session of 2002 and as may be subsequently amended; and

BE IT FURTHER RESOLVED that the Auditor is requested to analyze specifically the following areas in addition to any other areas required by statute:

(1) The costs and benefits of the services of hypnotherapists for the consumer; and

(2) A summary of existing laws of the other states that do and do not license hypnotherapists; and

BE IT FURTHER RESOLVED that the Auditor report findings and recommendations to the Legislature no later than 20 days prior to the convening of the Regular Session of 2003; and

BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Auditor and to the Director of Commerce and Consumer Affairs.
