HOUSE CONCURRENT

RESOLUTION

 

requesting the department of commerce and consumer affairs to study and develop legislation for the regulation of manufactured housing in Hawaii.

 

 

WHEREAS, it is the policy of the State to promote affordable housing and home ownership for residents; and

WHEREAS, the United States Department of Housing and Urban Development has developed regulations for manufactured housing in 24 C.F.R. 3282, which are known as the Manufactured Home Procedural and Enforcement Regulations; and

WHEREAS, among Hawaii's residents, Hawaiians and native Hawaiians in particular find it difficult to afford to buy homes that uses the more costly conventional building techniques; and

WHEREAS, the use of manufactured housing parts are available in Hawaii because these plants have been developed in Hawaii for the housing industry; and

WHEREAS, the Department of Commerce and Consumer Affairs is the designated state agency with a primary mission, among other things, of protecting consumers from unlicensed building trades; and

WHEREAS, the Department of Commerce and Consumer Affairs also develops administrative rules and makes legislative suggestions to promote consumer protection in the State; now, therefore,

BE IT RESOLVED by the House of Representatives of the Twenty-first Legislature of the State of Hawaii, Regular Session of 2002, the Senate concurring, that the Department of Commerce and Consumer Affairs is respectfully requested to develop legislation for the regulation of manufactured housing in Hawaii that is consistent with the standards set forth in the United States Department of Housing and Urban Development's Part 3282, Manufactured Home Procedural and Enforcement Regulations; and

BE IT FURTHER RESOLVED that the Department of Commerce and Consumer Affairs submit its findings and recommendations including suggested proposed legislation, to the Legislature, at least twenty days before the convening of the Regular Session of 2003; and

BE IT FURTHER RESOLVED that a certified copy of this Concurrent Resolution be transmitted to the Director of Commerce and Consumer Affairs.
