A BILL FOR AN ACT

 

relating to seniority of public school principals.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§302A- Transfers of principals between schools. (a) The length of tenure of principals within the department of education shall not be considered in determining whether or not a principal who has applied to transfer to an equivalent position at another school within the department may do so. Decisions concerning such transfers shall be made solely on the basis of professional merit.

(b) If it is determined that no material difference in merit exists between two or more principals who have applied to transfer to the same position, a neutral method shall be used to select which principal shall fill the vacancy."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
