A BILL FOR AN ACT

 

relating to the land court.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 501, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§50l- Deregistration. The owner of land registered pursuant to this chapter may deregister that land and remove the land from the operation of this chapter by petition to the land court for an order directing the registrar to record, pursuant to chapter 502, a copy of the certificate of title for that land. Upon recordation of the certificate of title in the bureau of conveyances of the State, the land shall no longer be registered nor shall this chapter apply, and all encumbrances listed on the certificate of title shall thereafter be treated as if the land had not been registered in the land court and the encumbrances had been recorded in the bureau of conveyances as of the date of recordation."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
