A BILL FOR AN ACT

 

relating to state departments.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The purpose of this Act is to require that appointment of persons to positions of executive director of the Hawaii tourism authority and first deputy or first assistant to the head of any department of the State be subject to confirmation by the senate.

SECTION 2. Section 26-39, Hawaii Revised Statutes, is amended to read as follows:

"§26-39 Department staffs; confirmation of first deputies or first assistants. (a) Except as otherwise provided by this chapter and with the approval of the governor, the head of a department may establish or abolish any subordinate office or position, transfer officers and employees between positions, appoint and remove any subordinate, and change the duties, titles, and compensation of offices and positions as is deemed necessary by the head of the department for the efficient functioning of the department, subject to the limitations of available appropriations and of the provisions of [chapters] chapter 76 [and 77].

(b) All first deputies or first assistants permitted under this section shall be subject to confirmation by the senate.

(c) All officers and employees within a department shall be under the supervision, direction and control of the head of the department, except as otherwise provided by this chapter."

SECTION 3. Section 201B-2, Hawaii Revised Statutes, is amended by amending subsection (f) to read as follows:

"(f) The board shall appoint an executive director, exempt from [chapters] chapter 76 [and 77,] but subject to confirmation by the senate, who shall oversee the authority staff[,]and shall be compensated at a salary level set by the governor."

SECTION 4. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 5. This Act shall take effect on December 31, 2050.
