A BILL FOR AN ACT
relating to the procurement code.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 103D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§103D- Establishment of the independent proposal evaluation committee. (a) There shall be an independent committee to evaluate proposals submitted, and recommend award of contracts, for requests for proposals solicited by state agencies pursuant to this chapter. The committee's purpose shall be to evaluate proposals submitted to the state in response to requests for proposals solicited by the state.
(b) The committee shall consist of 15 individuals, one of which shall be chosen by the committee members to be committee chairperson. The committee members shall consist of one each from the following life endeavors: accounting, architecture, general contracting, education, entertainment, food service, housewife, law, law enforcement, maritime service, media, medical, retailing, transportation, travel.
(c) The committee shall be on call available to all state departments. Members shall serve without remuneration for a two year term. The legislature shall compile a committee for approval by the governor
(d) For operational purposes, the committee will be assigned to the Office of the State Chief Procurement Officer. When a state agency solicits requests for proposals, the agency shall submit a request to the State Chief Procurement Officer for the committee chairman to gather an evaluation team consisting of at least five of the committee members to evaluate the proposals offered and recommend award.
(e) Any disagreement between the agency and the evaluation team's recommendation shall be referred to the governor for resolution.
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
