A BILL FOR AN ACT
relating to fundraising activities.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 11, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§11- Other prohibited activities. (a) It shall be unlawful for any candidate for election to any public office or for any public officer or employee, any portion of whose compensation is paid by the State or any county directly or indirectly, to solicit any political contribution from any person in any state or county room or building occupied in the discharge of official duties. This prohibition does not apply to school property.
(b) For purposes of this section:
"Political contribution" means a contribution for the purposes of influencing, interfering with or affecting the result of an election, and includes a gift, subscription, loan, advance, or deposit of money or anything of value, and contract, promise, or agreement, whether or not legally enforceable, to make a contribution.
"Public officer or employee" means any person holding a position in the service of a jurisdiction, including members of boards and commissions, and including elected public officers irrespective of status or type of appointment, and is not limited to members of the civil service."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
