A BILL FOR AN ACT

 

relating to the penal code.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 711-1107, Hawaii Revised Statutes, is amended by amending subsection (3) to read as follows:

"(3) [Desecration is a misdemeanor.] Any person convicted of committing the offense of desecration shall be sentenced to a term of imprisonment of not more than one year, a fine of not more than $5,000, or both.

SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
