A BILL FOR AN ACT
relating to EDUCATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that:
(1) The college of Hawaiian language was established at the University of Hawaii at Hilo to serve as a focal point for a statewide effort to revitalize the Hawaiian language for all the people of Hawaii through the use and study of the language;
(2) Four new century charter schools have been established that use Hawaiian as the primary medium of instruction and operation, which in turn creates unique administrative, professional, and technical needs and challenges for these schools;
(3) Three of the four new century charter schools that use the Hawaiian language as their primary medium of instruction have chosen to participate in the laboratory school program of the University of Hawaii at Hilo college of Hawaiian language;
(4) State promotion and use of Hawaiian would be served by closer association of Hawaiian medium charter schools with the college of Hawaiian language through the transfer of funds for administrative, professional, and technical services from the department of education to the University of Hawaii; and
(5) Hawaiian medium charter schools outside the laboratory school program should have the opportunity to receive administrative, professional, and technical services through the college of Hawaiian language if they choose to request these services from the college.
SECTION 2. The legislature finds and declares that the transfer of funds from the department of education to the University of Hawaii, for the provision of administrative, professional, and technical services, as set forth in this Act, is a law of statewide concern.
SECTION 3. Act 259, Session Laws of Hawaii 2001, is amended by adding six new sections to part III to be appropriately designated and to read as follows:
"EDUCATION
SECTION 54A. Provided that of the general fund appropriation for school-based budgeting (EDN 100) for fiscal year 2002-2003, the sum of $ or $ per pupil, whichever is less, shall be transferred to University of Hawaii, Hilo (UOH210) for the purpose of allowing the university to provide administrative, professional, and technical services through the Hawaiian language to:
(1) New century charter schools participating in the laboratory school program of the University of Hawaii at Hilo college of Hawaiian language; and
(2) Upon request, new century charter schools outside the laboratory school program of the University of Hawaii at Hilo college of Hawaiian language.
SECTION 54B. Provided that of the general fund appropriation for comprehensive school support services (EDN 150) for fiscal year 2002-2003, the sum of $ or $ per pupil, whichever is less, shall be transferred to University of Hawaii, Hilo (UOH210) for the purpose of allowing the university to provide administrative, professional, and technical services through the Hawaiian language to:
(1) New century charter schools participating in the laboratory school program of the University of Hawaii at Hilo college of Hawaiian language; and
(2) Upon request, new century charter schools outside the laboratory school program of the University of Hawaii at Hilo college of Hawaiian language.
SECTION 54C. Provided that of the general fund appropriation for instructional support (EDN 200) for fiscal year 2002-2003, the sum of $ or $ per pupil, whichever is less, shall be transferred to University of Hawaii, Hilo (UOH210) for the purpose of allowing the university to provide administrative, professional, and technical services through the Hawaiian language to:
(1) New century charter schools participating in the laboratory school program of the University of Hawaii at Hilo college of Hawaiian language; and
(2) Upon request, new century charter schools outside the laboratory school program of the University of Hawaii at Hilo college of Hawaiian language.
SECTION 54D. Provided that of the general fund appropriation for state and district administration (EDN 300) for fiscal year 2002-2003, the sum of $ or $ per pupil, whichever is less, shall be transferred to University of Hawaii, Hilo (UOH210) for the purpose of allowing the university to provide administrative, professional, and technical services through the Hawaiian language to:
(1) New century charter schools participating in the laboratory school program of the University of Hawaii at Hilo college of Hawaiian language; and
(2) Upon request, new century charter schools outside the laboratory school program of the University of Hawaii at Hilo college of Hawaiian language.
SECTION 54E. Provided that of the general fund appropriation for school support (EDN 400) for fiscal year 2002-2003, the sum of $ or $ per pupil, whichever is less, shall be transferred to University of Hawaii, Hilo (UOH210) for the purpose of allowing the university to provide administrative, professional, and technical services through the Hawaiian language to:
(1) New century charter schools participating in the laboratory school program of the University of Hawaii at Hilo college of Hawaiian language; and
(2) Upon request, new century charter schools outside the laboratory school program of the University of Hawaii at Hilo college of Hawaiian language.
SECTION 54F. Provided that of the general fund appropriation for school community service (EDN 500) for fiscal year 2002-2003, the sum of $ or $ per pupil, whichever is less, shall be transferred to University of Hawaii, Hilo (UOH210) for the purpose of allowing the university to provide administrative, professional, and technical services through the Hawaiian language to:
(1) New century charter schools participating in the laboratory school program of the University of Hawaii at Hilo college of Hawaiian language; and
(2) Upon request, new century charter schools outside the laboratory school program of the University of Hawaii at Hilo college of Hawaiian language."
SECTION 4. New statutory material is underscored.
SECTION 5. This Act shall take effect upon its approval.
