A BILL FOR AN ACT
RELATING TO MARRIAGE AND FAMILY THERAPY.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that the Auditor's 2002 sunset evaluation report on marriage and family therapists made recommendations for legislative action to be taken if the legislature continues the regulation of marriage and family therapists.
The purpose of this Act is to partially implement the Auditor's recommendations by extending the law's sunset date and authorizing the director of commerce and consumer affairs to enter into reciprocity agreements allowing the recognition of licenses of marriage and family therapists issued by other states.
SECTION 2. Chapter 451J, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§451J- Reciprocity. The director may enter into a reciprocity agreement with another state and issue a license to a marriage and family therapist who is licensed in that state; provided that the requirements for a license in that state are deemed by the director to be at least as stringent as the current requirements for a license in this State."
SECTION 3. Section 26H-4, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:
"(b) (1) Chapter 451J (marriage and family therapists) shall be repealed on December 31, [2002;] 2006; and
(2) Chapter 457G (occupational therapy practice) shall be repealed on December 31, 2003."
SECTION 4. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 5. This Act shall take effect upon its approval.
