A BILL FOR AN ACT

 

relating to a center for nursing.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 457, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§457- Center for nursing; objectives. (a) There is established the center for nursing within the board of nursing to address issues of supply and demand for nursing, including issues of recruitment, retention, and utilization of nurse workforce resources.

(b) The objectives of the center shall be to:

(1) Develop a strategic statewide plan to accommodate current and future workforce conditions in the State;

(2) Initiate and maintain communication between the State and the nursing profession, business, and community groups to implement the goals of the center; and

(3) Conduct research and analysis of relevant nursing workforce data and publish and otherwise disseminate research and analysis conducted by the center.

(c) The center for nursing shall be headed by an executive director, who shall not be subject to chapter 76, and who shall be hired by the board of nursing. With the approval of the board and subject to available funding, the executive director may hire nurse researchers and nurse educators.

(d) Under the direction of the executive director of the center for nursing, who shall report directly to the board, the center shall have the following duties:

(1) Review, publish, and comment on data analysis prepared by the center;

(2) Recommend systemic changes, including strategies for implementation of recommended changes;

(3) Evaluate and report the results of these efforts to the legislature and others;

(4) Promote and publish an analysis of the collected nursing workforce data and evaluate the effectiveness of staffing analysis and acuity measurements by:

(A) Sharing and collaborating with other states that collect health data, nursing workforce outcomes, and related data, including direct nursing care quantitative data;

(B) Conducting research and evaluating data on registered nurses, advanced practice registered nurses, licensed practical nurses, and nurses’ aides to ensure that distinctions in scope, practice, and practice settings are properly analyzed;

(C) Utilizing data compiled by other sources, including academic sources, which facilitates analysis of nurse staffing, patient outcomes, and quality analysis;

(D) Determining and publishing information on state, regional, and local nursing workforce shortages; and

(E) Conducting and evaluating research focused on ensuring quality patient care, and developing data on nurse staffing, including the amount of direct nursing care, outcome indicators, acuity systems, nurse competence, and the impact of unlicensed assistive personnel on nursing care; and

(5) Promote recruitment and retention of nurses.

(e) The center shall work with schools of nursing, including that at the University of Hawaii, to collect data on nursing supply and shortages for the purpose of determining enrollment, educational curriculum, and other nursing workforce needs.

(f) There is established the center for nursing advisory committee, whose sole duty shall be to advise the board of nursing on matters relating to the center for nursing. The advisory committee shall be composed of twelve members to be appointed by the governor as follows:

(1) Two members shall be nurses, one of which shall be a doctoral prepared nurse educator and one of which shall be a doctoral prepared nurse researcher;

(2) Five members shall represent business, labor, the health care industry; provided that at least one member shall represent the health care industry;

(3) Three members shall represent community agencies, at least one of which shall represent a consumer group; and

(4) Two members to be nominated by the Hawaii Nurses’ Association.

Of the initial members, five shall serve three years, four shall serve two years, and three shall serve one year. Thereafter, all members shall serve three years; provided that no member may serve more than two consecutive three-year terms. Members shall select from among themselves a chairperson and other officers as necessary. Members of the advisory committee shall not receive compensation but may be reimbursed for necessary expenses, including travel expenses.

(g) The center for nursing advisory committee shall make recommendations to the board of nursing on the following issues:

(1) The hiring of an executive director for the center, nurse researchers, and nurse educators;

(2) Operational policy of the center for nursing;

(3) Implementation of the major objectives of the center;

(4) Securing funding for the center, including state appropriations and private funding; and

(5) Sharing of information with other authorized health data collection agencies.

(h) Nothing in this section shall prohibit or preclude any institution, the center for nursing, or any other government entity from sharing workplace, staffing, or health data collected by the State with any state-authorized health data collection entity or any other entity that is authorized by the State to obtain the data for research purposes. Any public or private entity which obtains data under this section shall comply with all state and federal confidentiality requirements and shall only use the data for health research purposes."

SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $100,000, or so much thereof as may be necessary for fiscal year 2002-2003, for the board of nursing to establish and operate the center for nursing. The sum appropriated shall be expended by the department of commerce and consumer affairs.

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect on July 1, 2002.
