A BILL FOR AN ACT
relating to cacao, cocoa, and chocolate products.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 486, Hawaii Revised Statutes, is amended by adding a new section to part V to be appropriately designated and to read as follows:
"§486- Cacao, cocoa, and chocolate products; labeling requirements. (a) If a label on a consumer package contains language that all of the raw or processed cacao beans contained in the package were grown in Hawaii, the label shall be worded, as appropriate:
(1) "100% Hawaii Chocolate", "100% Hawaiian Chocolate", "Genuine Hawaii Chocolate", or "Genuine Hawaiian Chocolate";
(2) "100% Hawaii Cocoa", "100% Hawaiian Cocoa", "Genuine Hawaii Cocoa", or "Genuine Hawaiian Cocoa"; or
(3) "100% Hawaii-Grown Cacao", "100% Hawaiian Cacao", "Genuine Hawaii-Grown Cacao", or "Genuine Hawaiian Cacao";
and shall appear on the principal display panel of the package.
(b) All nonconsumer packages containing cacao beans grown in the State and introduced into intrastate or interstate commerce, shall bear on the package a label containing language that the package contains Hawaii-grown cacao beans. This label shall be in addition to all other labeling requirements specified in this chapter.
(c) Any person keeping, offering, displaying, exposing for sale, or soliciting for sale, any raw or processed cacao, cocoa, or chocolate product, which represents or which is branded or labeled that the cacao beans were grown in Hawaii, shall make available to the administrator, upon demand, documented proof that one hundred per cent of the cacao beans were grown in the State.
(d) It shall be a violation of this part to use a label containing the words specified in subsection (a)(1), (2), or (3), or similar wording, if any portion of the cacao beans contained in the package are not grown in the State."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
