A BILL FOR AN ACT
RELATING TO invasive species funding.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 150A, Hawaii Revised Statutes, is amended by adding a new part to be appropriately designated and to read as follows:
"PART . PEST SPECIES
§150A- Pest species task force. (a) There is established a pest species task force consisting of thirteen members, which shall include:
(1) Four members with expertise in biology, botany, zoology, microbiology, ecology, or other disciplines relating to the protection of natural resources as evidenced by an academic degree or other special experience;
(2) Three members representing air common carriers;
(3) Three members representing marine common carriers;
(4) One member each representing the agricultural, horticultural, and aquacultural industries.
The chairperson of the task force shall be elected by the members of the task force.
(b) The task force shall develop and implement a program of preventive measures to reduce the introduction of pest species through aircraft or vessels.
§150A- Air carriers, marine carriers; service charge. (a) To the extent authorized in title 49 United States Code section 1513 subsection (b), the department of transportation shall levy a service charge on each air carrier based on the schedule established pursuant to subsection (b) for the use of airport facilities for pest species inspection, quarantine, and eradication; provided that the task force has developed a program of preventative measures pursuant to section 150A- .
(b) Each air carrier, from a port of departure from which pest species that are prohibited or restricted by the State may originate or transit shall pay a charge of $85 to the department of transportation upon the initial landing at a port of entry in the State.
(c) To the extent authorized by federal law, the department of transportation shall levy a service charge on each marine carrier based on the schedule established pursuant to subsection (d), for the use of harbor facilities for pest species inspection, quarantine, and eradication; provided that the task force has developed a program of preventative measures pursuant to section 150A- .
(d) Each marine carrier, from a port of departure from which pest species that are prohibited or restricted by the State may originate or transit shall pay a charge of $200 to the department of transportation upon the initial arrival at a port of entry in the State.
(e) Each air carrier and marine carrier shall maintain the records required by this chapter and shall pay the charges and fees in this section to the department of transportation according to the rules adopted by the board.
(f) The charges and fees collected pursuant to this section shall be deposited in the pest species inspection, quarantine, and eradication fund.
§150A- Pest species inspection, quarantine, and eradication fund. (a) There is established in the state treasury the pest species inspection, quarantine, and eradication fund, into which shall be deposited:
(1) The charges and fees collected from air carriers and marine carriers pursuant to section 150A- ;
(2) Legislative appropriations for inspection and quarantine services;
(3) Fees collected for inspection and certification;
(4) Fines collected for violations of this chapter; and
(5) Federal funds received to maintain inspection and quarantine services.
(b) Moneys in the pest species inspection, quarantine, and eradication fund shall be used for the operation of inspection and monitoring facilities at ports of entry and the execution of emergency remedial measures when pest species are detected at ports of entry. All moneys for the execution of emergency remedial measures shall be expended under the supervision and control of the department."
SECTION 2. This Act shall take effect upon its approval.
