A BILL FOR AN ACT
RELATING TO research and bioremediation.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The University of Hawaii college of tropical agriculture and human resources has submitted a proposal to conduct additional research and bench scale testing for the treatment of dredged materials from the Ala Wai canal. The research work includes a biotreatability evaluation and additional research on chlordane-contaminated dredged material for $50,000 and $250,000, respectively. The bench scale testing would include a twelve-month screening program for plant species to remediate polycyclic aromatic hydrocarbons, halogenated hydrocarbons, and lead. The bench scale testing would cost approximately $100,000 and the total cost for the research and bench scale testing is $400,000.
The legislature finds that the successful completion of the above research and bench scale testing is essential for the development and design of a pilot bioremediation facility, which would be used to evaluate the performance, operation, and maintenance factors, and cost of various biological treatment processes identified in the research and bench scale testing phase.
The purpose of this Act is to appropriate funds for additional research and bench scale testing of material dredged from waterways statewide and to authorize issuance of general obligation bonds, to be matched by federal funds, for the design and construction of a pilot bioremediation facility.
SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $400,000 or so much thereof as may be necessary for fiscal year 2002-2003 to conduct the following research and tests on material dredged from the Ala Wai canal and other waterways statewide:
(1) A biotreatability evaluation;
(2) Research on chlordane-contaminated material; and
(3) Bench scale testing, including a twelve month screening program for plant species to remediate polycyclic aromatic hydrocarbons, halogenated hydrocarbons, and lead.
The sum appropriated in this section shall be expended by the department of land and natural resources for the purposes of this Act.
SECTION 3. The director of finance is authorized to issue general obligation bonds in the sum of $1,750,000 or so much thereof as may be necessary, and the same sum, or so much thereof as may be necessary, is appropriated for fiscal year 2002-2003 for the following project:
Plans, design, and construction of a pilot bioremediation facility, Oahu.

The sum appropriated in this section shall be expended by the department of accounting and general services for the purposes of this Act; provided that the sum appropriated in this section is matched by federal funds.
SECTION 4. The appropriation made for the capital improvement project authorized in section 3 of this Act shall not lapse at the end of the fiscal year for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2005, shall lapse as of that date.
SECTION 5. This Act shall take effect on July 1, 2002.
