A BILL FOR AN ACT
relating to animals.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 143, Hawaii Revised Statutes, is amended by inserting a new section to be appropriately designated and to read as follows:
"§143- Animal trespass. (a) Notwithstanding any other provision of law, any person who intentionally or recklessly brings an animal onto private or public real property where the presence of animals is lawfully prohibited by the owner of the real property, and where reasonable notice of the prohibition is conspicuously posted, shall serve forty-eight hours of community service, as follows:
(1) Sixteen hours of instruction at the nearest Humane Society office to learn the proper care and maintenance of animals;
(2) Eight hours service at a veterinarian facility or licensed pet clinic to learn about animal ailments and animal-borne parasites, viruses, and fungi that affect humans;
(3) Eight hours maintenance work and study of behavior at a park or other area set aside for use by animals and their owners; and
(4) Sixteen hours repairing damage to nature trails and other private and public property caused by animals in areas where the presence of animals are prohibited.
(b) This section shall be enforced in the manner and to the extent prescribed in sections 142-29, 142-30, and 142-31.
(c) This section shall not apply to guide, signal, or service animals licensed pursuant to section 143-4."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
