A BILL FOR AN ACT
relating to the protection of unborn children.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 707, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§707-_____Protection of unborn children. (a) Any person who engages in conduct that violates any of the provisions of law listed in this chapter and thereby causes the death or bodily injury to, a child, who is in utero at the time the conduct takes place, is guilty of a separate offense under this section.
(b) The punishment for that separate offense is the same as the punishment provided for under this chapter had the injury or death occurred to the unborn child's mother.
(c) Nothing in this section shall be construed to permit the prosecution of the following:
(1) Any person for conduct relating to an abortion for which the consent of the pregnant woman has been obtained or for which such consent is implied by law in a medical emergency;
(2) Any person for conduct relating to an abortion on an unemancipated minor for which proper consent was obtained as proscribed by §453-____ of the Hawaii Revised Statutes;
(3) Any person for any medical treatment of the pregnant woman or her unborn child;
(4) Any woman with respect to her unborn child.
(d) As used in this section, the term 'unborn child' means a child in utero."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
