A BILL FOR AN ACT
relating to amending the interpretive service requirement of lessees of kahana valley state park to include monetary payment.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that Kahana Valley State Park holds unique historical and natural resources and residents long associated with the land who are knowledgeable and qualified to interpret the significance of its resources for the public's benefit and enjoyment.
The legislature also finds that these qualified residents of Kahana Valley hold 65-year leases with the State of Hawaii. In exchange for those leases, each household must perform 25 hours of interpretive services per month with a further condition that the hours must be performed by a household member 15 years of age or older. Due to the length of these leases, many residents required to perform such interpretive services are elderly or infirmed and, thus, incapable of performing some or all of their lease requirements.
Accordingly, the purpose of this Act is to amend the interpretive service requirement of the long-term leases to reflect a more plausible condition for existing and future lessees.
SECTION 2. The department of land and natural resources shall re-execute existing and amend all future leases for Kahana Valley State Park by establishing provisions for a lower requirement of interpretive service to be determined by the department of land and natural resources as well as an option for reasonable monetary payment in place of the interpretive services for elderly and infirmed lessees, the amount to be determined by the department of land and natural resources yet not to exceed $_______.
SECTION 3. For the purposes of this Act, "elderly" shall mean a person 65 years of age or older; "infirmed" shall mean any person who is certified physically incapable of performing the required interpretive services by two physicians licensed by the State of Hawaii.
SECTION 4. Notwithstanding any other law to the contrary, including chapter 171, Hawaii Revised Statutes, the department of land and natural resources is authorized and directed to amend the provisions and limitations in accordance this Act within one year from the effective date of this Act.
SECTION 5. This Act shall take effect upon its approval.
