A BILL FOR AN ACT

 

relating to traffic cameras.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Notwithstanding any other law to the contrary, any contracts entered into by the department with a contractor pursuant to Act 234 Session Laws of Hawaii 1998, as amended by Act 263, Session Laws of Hawaii 1999, and Act 240, Session Laws of Hawaii 2000, or for any program using cameras or automated technology to enforce traffic regulations, shall require the approval of a county in order for the project to be implemented within the county. Approval of the contract by the county shall be in the form of a resolution passed by the respective county council after public hearings on the issue.

SECTION 2. If any provision of this Act, or the application thereof to any person or circumstance is held invalid, the invalidity does not affect other provisions or applications of the Act, which can be given effect without the invalid provision or application, and to this end the provisions of this Act are severable.

SECTION 3. This Act shall take effect upon its approval.
