A BILL FOR AN ACT

 

RELATING TO DRIVER'S EDUCATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that automobile accidents annually claim the lives of many young drivers. Current legislation fails to remedy this recurring tragedy. The purpose of this Act is to create a mandatory defensive driving program to provide those drivers who perpetually place their own lives and the lives of others at risk with additional training designed to address the unsafe habits of the repeat offenders.

SECTION 2. Chapter 286, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§286- Defensive Driving Program. The director of transportation is directed to establish and certify a statewide defensive driving program, to include a practical, hands-on driving course, the number of course hours, curriculum, and certification of teachers and third-party examiners. The director of transportation is also directed to set a cost for the programs to enable the programs to be self-sufficient. The director of transportation shall adopt rules pursuant to chapter 91 necessary for the purposes of this section."

SECTION 3. Chapter 291, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§291D- Mandatory Defensive Driving Program; three or more moving violations. (a) A person found to have committed three or more moving violations shall be ordered to attend and complete the defensive driving program as established by the department of transportation pursuant to chapter 286 of the Hawaii Revised Statutes."

SECTION 4. There is appropriated out of the general revenues of the State of Hawaii the sum of $____________, or so much thereof as may be necessary for fiscal year 2002-2003, for establishing a mandatory defensive driving program at Kalaeloa.

SECTION 5. The sum appropriated shall be expended by the department of transportation for the purposes of this Act.

SECTION 6. New statutory material is underscored.

SECTION 7. This Act shall take effect on July 1, 2002.
