A BILL FOR AN ACT
relating to motorcycle operator education.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 286-108.4, Hawaii Revised Statutes, is amended to read as follows:
"[[]§286-108.4 Driver education and behind-the-wheel driver training program.[]] (a) The director of transportation is directed to establish and certify a statewide driver education program and behind-the-wheel driver training program, to include the number of course hours, curriculum, and certification of teachers and third-party examiners. The director of transportation is also directed to set a cost for the programs to enable the programs to be self-sufficient. The director of transportation shall adopt rules pursuant to chapter 91 necessary for the purposes of this [[]section[]].
(b) With respect to a motorcycle operator education program operated in the State by any branch of the United States armed services, a motorcycle operator education program that:
(1) Meets standards established by the Motorcycle Safety Foundation; and
(2) Is certified by the respective armed forces' installation commander;
shall be deemed approved and certified by the director of transportation."
SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
