         defining scope of regulated transmissions,
         requiring advertisers to provide a phone number
         or electronic address at which recipients may

         transmissions, requiring advertisers to add
         initial, identifying letters to e-mail
         advertising messages and advertising with adult
         content, and authorizes electronic service
         providers to establish a policy restricting
         unsolicited e-mail transmissions and bring a
         civil action for actual or liquidated damages
         caused by knowing violation of the policy.

         Increases judicial salaries retroactive to

         Requires a court, upon sentencing a defendant to
         probation, deferring a guilty plea, or deferring

         to pay a probation service fee of $100 for a term
         of more than one year, or $50 for a term of one
         year or less. Establishes the probation services
         special fund.

         Requires nonconsensual common law liens to
         designate whether they are directed at a public
         officer or employee.

         Authorizes the issuance of general obligation
         bonds and making an appropriation for capital
         improvement projects for the benefit of the
         county of Kauai.

2667     RELATING TO LIMITED LIABILITY FOR COUNTIES.         WLU,JHA
         Limits counties' liability for hazardous
         recreational activities including animal riding,
         hiking, off-road motorcycling, hang gliding,
         rodeo, sport parachuting, among other activities,
         except when death or injury occurred as a direct
         result of county's failure to warn when the
         county had actual knowledge of physically
         hazardous conditions, or physically hazardous
         condition not known or would not have been known
         to reasonably prudent person, or for gross
         negligence, recklessness, or wilful, wanton,
         deliberate conduct.

2668     RELATING TO PUBLIC LAND.                            WLU,JHA
         Declares that the government is not liable for
         accidents and injuries occurring on unimproved
         public land. Repeals Act 190, SLH 1996.

2669     RELATING TO MOTOR VEHICLES.                         TRN,FIN
         Assigns fees collected from traffic infraction
         fines to the counties in which the infractions
         are committed and the state agency which
         maintains traffic enforcement and safety
         programs.

2670     RELATING TO TRANSIENT ACCOMMODATIONS TAX.           TSM,FIN
         Reduces the amount of transient accommodations
         revenue distributed to the Hawaii tourism
         authority from 37.9% to 6%. Increases amount
         distributed to counties from 44.8% to 76.7%.

2671     RELATING TO EXEMPTING THE COUNTIES FROM GENERAL
         EXCISE TAX.                                         FIN
         Exempts the county governments and amounts
         received from the county governments from the
         general excise tax.

         overtime compensation for police officers

         facie evidence of value and ownership of goods
         and merchandise. Includes legal owner in
         definition of "owner" of propelled vehicle.

         Amends definition of "substantial bodily injury"
         to include any second degree burn or a
         concussion.

         Amends definition of "bookmaking" to include
         accepting bets from one member of the public.

         misdemeanor and extends definition of crime to
         include the risk of creating a hazardous
         condition or public nuisance.

2682     PROPOSING AN AMENDMENT TO ARTICLE V OF THE HAWAII
         CONSTITUTION TO PROVIDE FOR THE ELECTION OF THE
         ATTORNEY GENERAL (ConAm).                           JHA,FIN
         Proposes an amendment to the Hawaii Constitution
         to provide for an elected attorney general.

2683     RELATING TO DRUGS.                                  JHA
         Repeals provisions that allow a conditional
         discharge and expunging of court records in a
         case where a person does not have a previous drug
         conviction.

2684     RELATING TO SENTENCING.                             JHA
         Clarifies the method by which presentence credit
         for detention is applied to calculate consecutive
         terms of imprisonment by requiring that all
         applicable terms of imprisonment first be
         aggregated before credit for pretrial detention
         is deducted, and that a single period of pretrial
         detention only be credited once.

2685     RELATING TO BURGLARY.                               JHA
         Provides that a person may commit burglary even
         if initial building entry was lawful. Defines
         "dangerous instrument".

2686     RELATING TO SENTENCING.                             JHA
         Adds unauthorized entry into motor vehicle to
         crimes subject to repeat offender sentencing.
         Expands enhanced sentencing to include attempted
         murder in the second degree. Disallows deferred
         proceedings for felonies that involve substantial
         bodily injury.

2687     RELATING TO TRAFFIC OFFENSES.                       TRN,JHA
         Replaces the term traffic "accident" with the
         term traffic "collision".

2688     RELATING TO CRIMINAL OFFENSES.                      TRN,JHA
         Changes from misdemeanor to petty misdemeanor and
         not more than $1,000 fine or imprisonment of not
         more than 30 days, or both, for violations of
         rules pertaining to airport security, safety
         measures, and persons engaged in commercial
         activities at public airports. Changes penalties
         for drag racing from 6 months to 30 days
         imprisonment.

2689     RELATING TO DEPENDENT ADULTS.                       HSH,JHA
         Requires family/household members to report to
         DHS or police when adult is in need of medical
         treatment or care and is at risk of death or
         serious bodily injury.

2690     RELATING TO VICTIMS AND WITNESSES.                  JHA
         Provides that victims and witnesses can testify
         at trial and grand jury by closed circuit video
         or video conferencing.

2691     RELATING TO DRIVING UNDER THE INFLUENCE OF DRUGS.   TRN,JHA
         Reduces jail time for driving under the influence
         of drugs by conforming the penalties with those
         provided for driving under the influence of
         intoxicating liquor. Makes reduced penalties
         retroactive to first-offense pending cases.

2692     RELATING TO DRIVING UNDER INFLUENCE.                TRN,JHA
         Allows police to select choice of test for an
         arrestee for driving under the influence of drugs
         or driving under the influence of intoxicating
         liquor. Permits refusal of test to be admissible
         in other proceedings. Changes definition of
         drugs.

2693     RELATING TO SENTENCING.                             JHA
         Clarifies that firearms offenses are
         nonprobationable and are not subject to a special
         indeterminate term of imprisonment for a young
         adult defendant.

2694     RELATING TO REALLOCATING TOBACCO SETTLEMENT FUND
         MONEYS TO CHILDREN'S PROGRAMS.                      HLT,FIN
         This bill increases the percentage of moneys from
         the tobacco settlement fund to the Department of
         Health. Additional types of programs are
         described for possible funding by the department
         of health, including child abuse prevention
         programs, child and adolescent mental health
         programs, and health promotion and disease
         prevention programs targeted specifically for
         children. The rainy day fund is also sunseted.

         order to regulate two industries, personal
         property appraisers and platinum jewelry dealers.

         Removes requirement of U.S. citizenship from
         voter's eligibility to vote in OHA elections.

         Transfers all OHA's assets and resources to the
         Hawaiian Homes Commission.

         Provides for the transfer of the management of

         Repeals provisions that allow collective

         to provide proof of one year residency in the

         fill a vacancy.

         Places cap on government copying fees. Preempts
         contrary county law.

2714     RELATING TO A VOLUNTARY SUBSTANCE ABUSE

         This bill creates a new type of public school, a
         voluntary substance abuse rehabilitation school.
         This bill sets forth the structure of the school
         including eligibility requirements, program
         content, and operational parameters.

2715     RELATING TO THE KAHOOLAWE ISLAND RESERVE.           OMR,JHA
         Amends area authorized for fishing around
         Kahoolawe to allow for fishing in waters at least
         20 fathoms deep and at least 100 yards from the
         island of Kahoolawe.

2716     RELATING TO CONDOMINIUMS.                           CPC
         Clarifies that a board of directors of a
         condominium association that solicits proxies
         using association funds must comply with the 30-
         day notice requirement. Authorizes use of copy,
         fax or other reliable reproduction of proxies.

2717     RELATING TO TERRORISM.                              PSM,JHA
         Provides for protections and penalties for the
         threat of use of weapons of mass destruction.

2718     RELATING TO BUSINESS OR DEVELOPMENT-RELATED

         Repeals existing law requiring agencies to take
         action to grant or deny any application for a
