AGENDA:

One of the lessons  learned  during  the  recodification of the Hawaii education
statutes in  1996  is  that  coherence  leads  to  access  and  access  leads to
accountability.  This  informational  briefing  will  describe  what this lesson
means and how it was learned.  Areas that will be covered include:  a historical
perspective on Hawaii's education statutes, a  look at the statutes "before" the
recodification  and  then  "after",  and  how  legislators  can  use  the policy
framework to track education bills and make decisions during the session.

              OF THE HAWAII CONSTITUTION, TO CHANGE THE SELECTION PROCESS OF THE
              UNIVERSITY OF HAWAII BOARD OF REGENTS.
              Proposes constitutional amendments to the selection process of the
              University of Hawaii board of regents.
HB 2812       PROPOSING AN AMENDMENT TO ARTICLE X,                   HED/JHA,FIN
              SECTION 6, OF THE  HAWAII  CONSTITUTION, TO PROVIDE THE UNIVERSITY
              OF HAWAII WITH AUTONOMY IN ALL MATTERS.
              Constitutional  amendment  to  give  UH  autonomy  in  all matters
              related to the university.
HB 2813       RELATING TO THE UNIVERSITY OF HAWAII.                  HED,LAB/FIN
              Provides complete autonomy to the  University of Hawaii, by making
              its status  comparable  to  that  of  the  judiciary.    Makes all
              employees   subject   to   the   university's   personnel  system.
              Eliminates director of  finance  and  governor from the university
              budgetary process.
HB 2060       RELATING TO THE UNIVERSITY OF HAWAII.                      HED,FIN
              Authorizes the University of  Hawaii community colleges to deposit
              their special fund revenues into system special funds.
HB 2062       RELATING TO HIGHER EDUCATION.                              HED,FIN
              Allows UH to carry over funds from one year to the next.
HB 2900       MAKING AN APPROPRIATION FOR THE UNIVERSITY OF              HED,FIN
              HAWAII AT MANOA.
              Appropriates funds for special  education  teacher training at the

HSCR 2-00     Removes  trailer   exemptions   from   prohibitions   relating  to

              vehicles.  Prohibits  drivers  from consuming intoxicating liquors
              even if not operating the vehicle at the time.
HB 1807       RELATING TO TRAFFIC INFRACTIONS.                               JHA
              Amends the laws relating to parks, airports, and harbors to ensure
              that traffic infractions committed  in those areas are adjudicated
              uniformly as provided  in  chapter  291D, Hawaii Revised Statutes,
              relating to the adjudication of traffic infractions.
HB 994        RELATING TO NOTICE OF BREACH OR DEFAULT.                   JHA,FIN
              Proposes  to:  (1)  reduce  the  period  for  curing  non-monetary
              defaults under leases  and  patents  of  state  land from sixty to
              thirty days, subject to  necessary  extension  only in cases where
              required; and (2) permit the parties, by agreement, to give notice
              by facsimile.
HB 2208       RELATING TO COUNTIES.                                      JHA,FIN
              Redefines "government agency"  for  purposes  of the public notice
              requirement  by  not  including  the  counties  except  for  state
              procurement code and purchase of  health  and human services.  The
              redefinition would allow counties to  select its own rather than a
              state-selected publication in which to place a public notice.

              than overhead.
HB 2003       RELATING TO THE ESTABLISHMENT OF A VOLUNTARY           EEP,CPC,FIN

              Authorizes the PUC to  establish  a voluntary contribution fund to

              Doubles penalties for driving  under the influence of intoxicating
              liquor at a blood-alcohol level  of  .17  or more grams of alcohol
              per one hundred milliliters or  cubic  centimeters of blood or .17
              or more grams of alcohol per two hundred ten liters of breath.
HB 2317       RELATING TO INTOXICATING LIQUOR.                           TRN,JHA
              Suspends driver's license  for  6  months,  requires  100 hours of
              community service and  attendance  at  alcohol  and drug education
              program if an underage  person  violates  liquor laws.  For repeat
              offenders, suspends driver's license for  1  year and 150 hours of
              community service.
HB 2691       RELATING TO DRIVING UNDER THE INFLUENCE OF DRUGS.          TRN,JHA
              Reduces jail time  for  driving  under  the  influence of drugs by
              conforming the penalties with those provided for driving under the
              influence  of  intoxicating  liquor.     Makes  reduced  penalties
              retroactive to first-offense pending cases.
HB 2692       RELATING TO DRIVING UNDER INFLUENCE.                       TRN,JHA
              Allows police to select choice of test for an arrestee for driving
              under the influence of  drugs  or  driving  under the influence of
              intoxicating liquor.  Permits refusal  of test to be admissible in
              other proceedings.  Changes definition of drugs.
HB 2687       RELATING TO TRAFFIC OFFENSES.                              TRN,JHA
              Replaces  the  term  traffic  "accident"  with  the  term  traffic
              "collision".
HB 2729       RELATING TO TRANSPORTATION.                                TRN,FIN
              Appropriates funds to match federal moneys for a feasibility study
              to determine alternate traffic solutions  to service the West Maui
              area.
HB 2727       RELATING TO INTERISLAND VEHICLE TRANSFERS.                 TRN,CPC
              Repeals the requirement that  registered  owners of a vehicle with
              an outstanding loan cannot  ship  the  vehicle between the islands
              unless the owner obtains a notarized statement from the creditor.
HB 2823       RELATING TO MOTOR CARRIERS.                            TRN,EDN,CPC
              Exempts from the fees and charges of the motor carriers law, those
              persons engaged in the  transport  of school children and teachers
              to  and  from   school   and   school   functions,  and  providing
              transportation  at  special   rates   for  groups  and  conducting
              nonregular excursions.

              Provide flexibility in  utilizing  current permanent civil service
              personnel and/or exempt  personnel  to  carry  out  the duties and
              responsibilities of the Adult  and  Community Care Services Branch

              Requires family/household members to report  to DHS or police when
              adult is in need of medical  treatment  or  care and is at risk of
              death or serious bodily harm.
