              secured  by  a  mortgage  on  residential  property  owned  by the
              borrower and includes the cash advances to the borrower based upon
              the equity or the value in the borrower's owner occupied principal
              residence; and which requires no  payment of principal or interest
              until the entire loan becomes  due  and payable; and which is made
              by a lender licensed or chartered under state or federal law.
HB 2017       RELATING TO COLLECTION AGENCIES.                               CPC
              Exempts persons collecting debts for out-of-state clients by means
              of interstate communication,  from  collection agency registration
              and bonding requirements.
HB 2129       RELATING TO PAWN BROKERS AND SECONDHAND DEALERS.               CPC
              Requires  secondhand  dealers  and  pawn  brokers  ("dealers")  to
              legibly record information upon receipt  of an article.  Also adds
              a definition  for  "government  issued  identification", which are
              required  forms  of  identification  of  the  person  who provides
              articles to the dealers.
HB 2130       RELATING TO SECONDHAND DEALERS.                                CPC
              Requires secondhand dealers  to  include  in  the  record book the
              thumbprint of the person from whom the article was received.
HB 2218       RELATING TO INSURANCE.                                     CPC,FIN
              Authorizes   expenditures   out    of    the   captive   insurance
              administrative fund for promotional activities.
HB 2219       RELATING TO INSURANCE.                                         CPC
              Requires the insurance commissioner  to  treat as confidential all
              nonpublic financial information submitted by a captive insurer.

              Authorizes captive insurers  to  merge  or  convert into different

              Creates procedure for service of process upon UH; establishes that

              university general counsel.
HB 2063       RELATING TO THE UNIVERSITY OF HAWAII.                      HED,FIN
              Requires  UH  employer  contributions  for  retirement  and health
              insurance benefits for employees whose base salaries are funded by
              the UH tuition and fees  special  fund  to  be funded by the state
              general fund.
HB 2064       RELATING TO THE UNIVERSITY OF HAWAII.                      HED,FIN
              Changes general fund formula for  the  University of Hawaii from a
              percentage  of  tuition  revenues  to  12%  of  all  general  fund
              appropriations under the executive budget acts.
HB 2065       RELATING TO CAPITAL IMPROVEMENT PROJECTS FOR               HED,FIN
              HIGHER EDUCATION.
              Authorizes capital  improvement  projects  for  the  University of

              Appropriates general funds to  the  University  of Hawaii at Manoa
              for the school of ocean and earth science and technology.

              Enables the University  to  develop  a classification system which
              appropriately recognizes the scope and subject matter of work, and
              the scope and degree  of  responsibility  and the required minimum
              qualifications.
HB 2621       RELATING TO THE UNIVERSITY OF HAWAII.                      HED,JHA
              Requires service  of  process  on  the  University  to  be made by
              delivering a  copy  of  the  complaint  to  the University General
              Counsel  or  to  an  Associate  General  Counsel.    Requires  all

              Provides a tax credit for the production of ethanol.

              Authorizes the counties to enact and enforce ordinances to require
              that gasoline sold in the county for use in motor vehicles contain
              not more than 10% ethanol  by  volume.  Requires the department of
              business, economic development,  and  tourism to provide technical
              assistance to the counties as needed.

              Proposes numerous revisions  to  pesticides  regulations.  Exempts

HB 1860       RELATING TO ADMINISTRATIVE PROCEDURES.                     EDB,CPC
              Establishes  the  three-year  administrative  rules  review  pilot
              program requiring the Department  of Commerce and Consumer Affairs
              to examine its existing rules  and  begin the process of repealing
              obsolete, cumbersome, unnecessary, or overly restrictive rules.
HB 1861       RELATING TO ADMINISTRATIVE RULES.                          EDB,CPC
              Establishes a Rule Drafting Policy  Task Force to develop policies
              representing the public interest  in  rules that place the minimum
              burden necessary  on  governmental  and  private productivity, and
              guidelines and examples to  integrate  the  policies into the rule
              drafting process.  The task force is to prepare legislation adding
              the policies to Chapter 91, and providing for incorporation of the
              guidelines  and  examples  in   the  Hawaii  Administrative  Rules
              Drafting Manual.
HB 1862       RELATING TO ADMINISTRATIVE PROCEDURES.                     EDB,CPC
              Ensures that whenever an  administrative rule is adopted, amended,
              or repealed, the rule  conforms  to  the  related statutes.  Gives
              head  of  the  agency   affected   by  administrative  rules  more
              accountability for compliance and  conformity to statutes.  Allows
              an interested party to appeal the  adoption  of a rule by filing a
              petition for regulatory  review  under  the  Hawaii Small Business
              Regulatory Flexibility  Act  (Act  168,  SLH  1998).   Extends the
              sunset date of Act 168, SLH 1998,  from June 30, 2002, to June 30,

              or repealed, the rule  conforms  to  the  related statutes.  Gives
              head  of  the  agency   affected   by  administrative  rules  more
              accountability for compliance and  conformity to statutes.  Allows
              an interested party to appeal the  adoption  of a rule by filing a
              petition for regulatory  review  under  the  Hawaii Small Business
              Regulatory Flexibility  Act  (Act  168,  SLH  1998).   Extends the

              repealed shall be repealed  automatically  upon the effective date
              of this Act without  regard  to  chapter  91,  HRS.  Provides that

              rule that is adopted pursuant to the repealed statute or ordinance
              shall also be repealed automatically without regard to chapter 91,

HB 1865       RELATING TO BOARDS AND COMMISSIONS.                        EDB,CPC
              Provides that 30 days after  submission  of an Auditor's report to
              the legislature finding that a professional or vocational board or
              commission of a  regulatory  program  not  listed in section 26H-4
              fails to advance  the  public  interest  as  expressed in policies
              identified by the Legislature  in  section 26H-2, and recommending
              that the board or  commission  be  abolished, state maintenance of
              the board or commission shall cease, the terms of members of board
              or commission shall expire, and  further appointments to the board
              are prohibited unless disapproved by two-thirds vote of either the
              senate or house of representatives or by majority vote of both.
HB 2190       RELATING TO BOARDS AND COMMISSIONS.                        EDB,CPC
              Amends  Regulatory   Licensing   Reform   Act  policies  regarding
              regulation of professions  and  vocations,  to prohibit or require
              termination of regulations  that  are  unnecessary or redundant of
              existing protections.   Requires  the  DCCA  to  sunset a board or
              commission in the  absence  of  an  Act  expressly prohibiting the
              sunset, and upon any finding  of  the Legislative Auditor that the
              board or commission is redundant or unnecessary.
HB 2359       RELATING TO ADMINISTRATIVE RULES.                          EDB,CPC
              Provides for the automatic sunset of all administrative rules in 3
              years unless the impacted agency  is able to justify the existence
              of those rules to  the  legislature.   Requires the small business
              regulatory review board to  review  all  rules and report findings
              and recommendations to the legislature.
HB 2020       RELATING TO OBSOLETE LAWS.                                     EDB
              Repeals or makes  conforming  amendments  to various statutes that
              have either been repealed by implication, or by their own terms by
              operation of law, and  are  now  deemed  to be "functus", that is,
              have accomplished their  intended  purpose  and  are of no further
              force or effect.
HB 2022       RELATING TO STATUTORY REVISION: AMENDING, REENACTING,          EDB
              OR REPEALING VARIOUS PROVISIONS OF THE HAWAII REVISED STATUTES AND
              THE SESSION LAWS OF  HAWAII  FOR  THE PURPOSE OF CORRECTING ERRORS
              AND REFERENCES,  CLARIFYING  LANGUAGE,  AND  DELETING  OBSOLETE OR
              UNNECESSARY PROVISIONS.
              Amends, reenacts,  or  repeals  various  provisions  of the Hawaii
              Revised Statutes and the Session Laws of Hawaii for the purpose of
              correcting  errors  and   references,   clarifying  language,  and
              deleting obsolete or unnecessary provisions.

              Provides that the excise  tax  on  cigarettes shall be imposed and
              collected through the use  of  stamps  purchased by licensees, and
              affixed to cigarette packages.   Includes provisions for civil and
              criminal penalties,  and  for  forfeitures  of  cigarettes,  to be
              enforced  by  the  police  departments,  liquor  commissions,  the
              attorney  general,  and  prosecuting   attorneys.    Requires  the
              Director of Taxation to submit findings and recommendations to the
              legislature for the 2006 Session on effectiveness of Act.
HB 2277       RELATING TO THE HAWAII TOBACCO SETTLEMENT                  HLT,FIN
              SPECIAL FUND.
              Provides that the funds received by the Health Department from the
              Tobacco Settlement  for  health  promotion  and disease prevention
              programs shall not supplant  or  diminish  the funding of existing
              tobacco prevention  and  control  programs  or  any health related
              programs funded in whole or in part by the State.
HB 2422       RELATING TO THE ENFORCEMENT OF THE TOBACCO                 HLT,FIN
              SETTLEMENT AGREEMENT.
              The  purpose  of  this  bill  is  to:  (1)  establish  the Tobacco
              Enforcement  Special  Fund,  (2)  exempt  the  Tobacco Enforcement
              Special Fund  from  the  central  service  surcharge  and from the
              reimbursement for  departmental  administrative  expenses; and (3)
              amend the distribution of the tobacco settlement moneys.
HB 2423       RELATING TO TOBACCO PRODUCTS REPORT.                       HLT,JHA
              Establishes a reporting requirement to assist the Attorney General
              enforce a state  law  that  requires tobacco product manufacturers
              who sell tobacco products in  the State to deposit certain amounts
              into escrow based on the number of cigarettes sold.
HB 2811       RELATING TO HEALTH.                                    HLT,CPC,FIN
              Establishes an expedited process for  an  appeal of a managed care
              plan's decision.  Extends the  time  period to request an external
              review of a managed care  plan's final determination.  Establishes
              standards for  determining  whether  a  health  intervention  is a
              medical necessity.
HB 2550       RELATING TO MENTAL HEALTH PARITY.                      HLT,CPC,FIN
              To require  health  insurers  to  equitably  reimburse  for mental
              health treatment;  it  requires  full  "parity"  in  mental health
              treatment benefits relative to other health insurance benefits.

              COVERAGE.
              Requires parity for insurance coverage for mental health benefits;
              defines serious mental illness  as  mental disorders as defined in
              the  Diagnostic  and  Statistical  Manual,  except  for  specified
              conditions; deletes  exception  for  employers  with  25  or fewer
              employees; clarifies duties of  the Hawaii mental health insurance
              task force.
HB 2746       MAKING AN APPROPRIATION FOR THE PEER                   HLT,EDN,FIN
              EDUCATION PROGRAM.
              Appropriates  $1,145,845  to  maintain  and  expand  the  services
              provided by the Department of Health's peer education program.

HB 2894       RELATING TO SUBSTANCE ABUSE.                       HLT/PSM,JHA,FIN
              Establishes a substance abuse policy  council within the office of
              the governor  to  develop  statewide  policy  regarding education,

              under certain  conditions.    Establishes  penalties for violating
              this requirement.
HB 2168       RELATING TO LABOR.                                     LAB/EDB,FIN
              Ensures that employees who are  unemployed  due to a labor dispute
              shall not be disqualified for unemployment benefits if the parties
              have reached an impasse and prior  to  a work stoppage an offer is
              made to submit the dispute to binding arbitration.
HB 2564       RELATING TO EMPLOYMENT SECURITY.                       LAB/EDB,FIN
              Extends the  sunset  date  of  the  employment  and  training fund
              program through December 31, 2005.
HB 2919       RELATING TO HEALTH CARE COVERAGE.                      LAB/EDB,FIN
              Removes the provision limiting, to 1.5% of an employee's wages, an
              employee's contribution  toward  healthcare  premiums for coverage
              required under the Act, and  replaces it with the requirement that
              the employee's contribution shall  not reduce the employee's wages
              to less than the minimum wage.
HB 2984       RELATING TO MINIMUM WAGE.                              LAB/EDB,FIN
              Raises the minimum wage to $5.75 and increases incrementally based
              on the value of the  dollar  based  on the average annual consumer
              price index for the State of Hawaii.
HB 2552       RELATING TO MINIMUM WAGE.                              LAB/EDB,FIN
              Increases the minimum wage.

LAB ONLY:
HB 1829       RELATING TO LIVING WAGES.                                  LAB,FIN
              Establishes the living  wages  law  which  applies  to service and
              labor contracts.  Requires  employers  to  pay employees a wage no
              less than the hourly rates set under this law.
