STAND. COM. REP. NO. 21

                                 Honolulu, Hawaii
                                                   , 1999

                                 RE: H.B. No. 278

Honorable Calvin K.Y. Say
Speaker, House of Representatives
Twentieth State Legislature
Regular Session of 1999
State of Hawaii

Sir:

Your Committee on Human Services and Housing, to which was
referred H.B. No. 278 entitled:

"A BILL FOR AN ACT RELATING TO THE HAWAII YOUTH CORRECTIONAL
     FACILITY AND PROGRAM,"

begs leave to report as follows:

The purpose of this bill is to give delinquent youths
committed to a correctional facility an opportunity to better
their lives by providing treatment and correctional services.

The Office of Youth Services submitted testimony in support
of the intent of this measure. The Department of the Prosecuting
Attorney of the City and County of Honolulu submitted testimony
in opposition to this measure.

Your Committee is concerned with the increasing number of
youths being committed to correctional facilities without the
proper funding for appropriate treatment. Your Committee
continues to support programs that are an alternative to
incarceration.

However, it is understood that the court, in fashioning an
appropriate sentence, has included both rehabilitation and just
punishment. It is not the intent of this Committee to circumvent
the sentence ordered by the court, and therefore, respectfully
requests the Committee on Public Safety and Military Affairs to
review this matter.

                                 STAND. COM. REP. NO. 21
                                 Page 2

As affirmed by the record of votes of the members of your
Committee on Human Services and Housing that is attached to this
report, your Committee is in accord with the intent and purpose
of H.B. No. 278 and recommends that it pass Second Reading and be
referred to the Committee on Public Safety and Military Affairs.

                                   Respectfully submitted on
behalf of the members of the
                                   Committee on Human Services
                                   and Housing,

                                   ______________________________
                                   DENNIS A. ARAKAKI, Chair
