                    SENATE  CONCURRENT
                        RESOLUTION

  REQUESTING THE FEDERAL DEPARTMENT OF HOUSING AND URBAN
    DEVELOPMENT TO INVESTIGATE THE MANAGEMENT OF ALL STATE
    GOVERNMENT HOUSING PROJECTS. 


 1        WHEREAS, there are two housing projects in Hawaii which
 2   are being investigated by the Federal Department of Housing and
 3   Urban Development (HUD); and
 4   
 5        WHEREAS, the Legislature has received complaints of
 6   security deposit over-charging by housing managers; and
 7   
 8        WHEREAS, interest earned on security deposits for
 9   subsidized housing should accrue for the benefit of the tenants
10   and not the housing manager; and
11   
12        WHEREAS, the Legislature has received allegations of
13   breaches of contract where housing management has failed to
14   make all the repairs and arrangements necessary to maintain the
15   premises in a habitable condition; and
16   
17        WHEREAS, it is alleged that the State has failed to modify
18   its project facilities to accommodate the elderly, and
19   disabled; and
20   
21        WHEREAS, HUD is investigating the alleged failure of
22   housing projects to allow pet ownership for elderly tenants;
23   and
24   
25        WHEREAS, it is alleged that the housing management
26   employees have not been properly trained to interact with
27   housing project tenants; and
28   
29        WHEREAS, the Legislature is willing to intervene on behalf
30   of tenants residing in section 8 tenant-based projects; and
31   
32        WHEREAS, retention of section 8 subsidies would ensure the
33   success of ownership by tenant-based non-profit corporations;
34   now, therefore,

 1        BE IT RESOLVED by the Senate of the Twentieth Legislature
 2   of the State of Hawaii, Regular Session of 2000, the House of
 3   Representatives concurring, that the HUD is requested to
 4   investigate the management of federally funded projects; and
 5   
 6        BE IT FURTHER RESOLVED that HUD is requested to commit to
 7   preserving section 8 subsidies to ensure non-profit tenant
 8   ownership of section 8 tenant-based projects; and
 9   
10        BE IT FURTHER RESOLVED that the HUD is requested to report
11   findings and recommendations to the Legislature no later than
12   twenty days prior to the convening of the Regular Session of
13   2001; and
14   
15        BE IT FURTHER RESOLVED that certified copies of this
16   Concurrent Resolution be transmitted to the HUD, each member of
17   Hawaii's Congressional delegation, the Governor, the Senate
18   President, the Speaker of the House, and the Director of the
19   Department of Business, Economic Development, and Tourism.
