                   A  BILL  FOR  AN  ACT

RELATING TO MINIMUM WAGE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 481B, Hawaii Revised Statutes, is
 
 2 amended by adding a new section to be appropriately designated
 
 3 and to read as follows:
 
 4      "§481B-   Service charges.  Any hotel or restaurant applying
 
 5 a service charge for the sale of food or beverage services shall
 
 6 distribute the service charge to its employees or else clearly
 
 7 disclose to the purchaser of the services that the service charge
 
 8 is to pay for costs or expenses other than wages of employees."
 
 9      SECTION 2.  Section 387-2, Hawaii Revised Statutes, is
 
10 amended to read as follows:
 
11      "§387-2  Minimum wages.  Except as provided in section 387-9
 
12 and this section, every employer shall pay to each employee
 
13 employed by the employer wages at the rate of not less than
 
14 [$3.85 per hour beginning January 1, 1988, $4.75 per hour
 
15 beginning April 1, 1992, and] $5.25 per hour beginning January 1,
 
16 1993[.], $5.50 per hour beginning January 1, 2001, and $5.75 per
 
17 hour beginning January 1, 2002.  The hourly wage of a tipped
 
18 employee may be deemed to be increased on account of tips if the
 
19 employee is paid not less than twenty cents and, beginning

 1 January 1, 2001, forty cents, below the applicable minimum wage
 
 2 by the employee's employer and the combined amount the employee
 
 3 receives from the employee's employer and in tips is at least
 
 4 fifty cents more than the applicable minimum wage."
 
 5      SECTION 3.  Statutory material to be repealed is bracketed.
 
 6 New statutory material is underscored.
 
 7      SECTION 4.  This Act shall take effect on January 1, 2001.
