                   A  BILL  FOR  AN  ACT

RELATING TO RETURN OF PRESCRIPTION DRUGS.


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 461-11, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§461-11  Duties of registered pharmacist.  (a)  Every
 
 4 registered pharmacist in charge of a pharmacy shall comply with
 
 5 all laws and rules.  The pharmacist shall be responsible for the
 
 6 management of the pharmacy; and every activity thereof [which]
 
 7 that is subject to this chapter and the rules adopted to
 
 8 implement this chapter shall be under the pharmacist's complete
 
 9 control.
 
10      (b)  All registered pharmacists shall notify the board of
 
11 changes of business address within ten days.
 
12      (c)  Prescription drugs previously dispensed or distributed
 
13 by a pharmacist may be returned to and redispensed or
 
14 redistributed by the pharmacist if the prescription drug:
 
15      (1)  Is in its dispensed, unopened, tamper-evident single
 
16           user unit;
 
17      (2)  Has remained at all times in the control of a person
 
18           trained and knowledgeable in the storage and
 
19           administration of drugs in institutional facilities or
 
20           supervised living groups using the services of a

 1           consultant pharmacist;
 
 2      (3)  Has not been adulterated or misbranded, and has been
 
 3           stored under conditions meeting the United States
 
 4           Pharmacopoeia standards;
 
 5      (4)  Is returned and redispensed or redistributed before the
 
 6           expiration date on the unit; and
 
 7      (5)  Is not a controlled substance designated under chapter
 
 8           329."
 
 9      SECTION 2.  Statutory material to be repealed is bracketed.
 
10 New statutory material is underscored. 
 
11      SECTION 3.  This Act shall take effect upon its approval.
