                   A  BILL  FOR  AN  ACT

RELATING TO KIKALA-KEOKEA.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Act 314, Session Laws of Hawaii 1991, as
 
 2 amended, authorized the department of land and natural resources
 
 3 to negotiate and enter into long-term leases with persons of
 
 4 Hawaiian ancestry who were dispossessed or displaced from their
 
 5 homes at Kalapana as a result of the volcanic eruptions on the
 
 6 island of Hawaii.  The Act also authorized the department of land
 
 7 and natural resources to subdivide and provide for the creation
 
 8 of a residential subdivision in the Kikala-Keokea homestead area
 
 9 for persons who receive long-term leases from the department of
 
10 land and natural resources.  The purpose of this Act is to
 
11 provide funds for the development of infrastructure at Kikala-
 
12 Keokea by amending Act 242, Session Laws of Hawaii 1991.
 
13      SECTION 2.  Act 242, Session Laws of Hawaii 1991, is amended
 
14 by amending section 1 to read as follows:
 
15      "SECTION 1.  The purpose of this Act is to provide
 
16 [low-interest loans to the residents and citizens of Hawaii who
 
17 have suffered the loss of their homes and lands to the
 
18 devastating effects of the continued volcanic eruptions on the
 
19 island of Hawaii.  Under current law, chapters 127, 171, and 209,

 1 Hawaii Revised Statutes, some of Kilauea lava flow victims do not
 
 2 qualify for existing disaster recovery loans.  Some Kilauea lava
 
 3 flow residents and citizens do not have sufficient income to
 
 4 qualify for loan assistance to purchase replacement land and
 
 5 build a home.  These residents and citizens may be in need of a
 
 6 one-time public relief program with specific requirements for the
 
 7 repayment of low-interest loans to assist in rebuilding their
 
 8 homes in an area of lesser volcanic risk.] funds for the
 
 9 development of infrastructure at Kikala-Keokea."
 
10      SECTION 3.  Act 242, Session Laws of Hawaii 1991, is amended
 
11 by amending section 2 to read as follows:
 
12      "SECTION 2.  There is appropriated out of the general
 
13 revenues of the State of Hawaii the sum of [$1,750,000,]
 
14 $         , or so much thereof as may be necessary for fiscal
 
15 year 1991-1992, to provide [low-interest land acquisition, home
 
16 construction, and mortgage loans of up to $35,000 each to
 
17 residents and citizens of Hawaii] funding for infrastructure
 
18 development to benefit residents of Hawaiian ancestry who have
 
19 been dispossessed of their homes and lands at Kalapana as a
 
20 result of the continued volcanic eruptions on the island of
 
21 Hawaii which began on January 3, 1983[; provided that the rate of
 
22 interest on loans pursuant to this Act shall not exceed three per

 1 cent per annum and interest earnings on loans made pursuant to
 
 2 this Act may be used for administrative and other expenses
 
 3 necessary for administering the loan program.  Guidelines shall
 
 4 be established by the housing finance and development corporation
 
 5 with respect to loan terms and loan qualification criteria.
 
 6 Moneys appropriated for the purposes of this Act shall be
 
 7 deposited into the housing finance revolving fund; provided that
 
 8 upon fulfillment of the purposes of this Act, all unencumbered
 
 9 moneys shall lapse into the state general fund]."
 
10      SECTION 4.  Act 242, Session Laws of Hawaii 1991, is amended
 
11 by amending section 3 to read as follows:
 
12      "SECTION 3.  [The housing finance and development
 
13 corporation shall administer the loans for the purposes of this
 
14 Act, and shall adopt rules pursuant to chapter 91 to carry out
 
15 the purposes of this Act.] There is created an infrastructure
 
16 development fund to be administered by the department of land and
 
17 natural resources.  The funds appropriated for the purposes of
 
18 this Act and all the moneys received or collected by the
 
19 department of land and natural resources shall be deposited into
 
20 the infrastructure development fund.  The proceeds may be used
 
21 for the necessary expenses in administering this Act; provided
 
22 that upon fulfillment of the purposes of this Act, all

 1 unencumbered moneys shall lapse into the state general fund."
 
 2      SECTION 5.  Act 242, Session Laws of Hawaii 1991, is amended
 
 3 by amending section 4 to read as follows:
 
 4      "SECTION 4.  The sum appropriated shall be expended by the
 
 5 [housing finance and development corporation] department of land
 
 6 and natural resources for the purposes of this Act[.]; provided
 
 7 that all funding commitments to complete the design and
 
 8 construction of infrastructure improvements shall be executed
 
 9 before any moneys can be disbursed."
 
10      SECTION 6.  The director of finance, as of the close of
 
11 business on June 30, 2000, shall transfer the unexpended balance,
 
12 including encumbrances and accrued liabilities of the moneys
 
13 appropriated and deposited into the housing finance revolving
 
14 fund pursuant to Act 242, Session Laws of Hawaii 1991, into the
 
15 infrastructure development fund established pursuant to section 4
 
16 of this Act.  Encumbered moneys shall continue to be encumbered
 
17 until paid out or released from prior encumbrances.
 
18      SECTION 7.  Statutory material to be repealed is bracketed.
 
19 New statutory material is underscored.
 
20      SECTION 8.  This Act shall take effect on July 1, 2999.
