                   A  BILL  FOR  AN  ACT

RELATING TO SEX OFFENDERS. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 846E, Hawaii Revised Statutes, is
 
 2 amended by amending by adding a new section to be appropriately
 
 3 designated and to read as follows:
 
 4      "§846E-    Department of education; obtaining information
 
 5 required.  (a)  The department of education shall access
 
 6 information on registered sex offenders under section 846E-3(d):
 
 7      (1)  For persons expected to do over five consecutive days
 
 8           of volunteer work in close proximity to children; and
 
 9      (2)  For any employee or applicant for employment, whenever
 
10           deemed necessary by the department.
 
11      (b)  For purposes of this section, notwithstanding section
 
12 846E-3(d), access to information shall be furnished upon a phone
 
13 call to the Hawaii criminal justice data center; provided that no
 
14 fee shall be assessed to access the information by phone.
 
15      (c)  As used in this section, "services" includes sport
 
16 activities, recreational activities, after-school and weekend
 
17 activities, community-school activities, and arts and crafts, or
 
18 any other extracurricular activities for children."
 
19      SECTION 2.  New statutory material is underscored.
 
20      SECTION 3.  This Act shall take effect upon its approval.
