                   A  BILL  FOR  AN  ACT

RELATING TO VOTER REGISTRATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 11-17, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§11-17 Removal of names from register, when;
 
 4 reregistration.(a) The clerk, not later than 4:30 p.m. on the
 
 5 sixtieth day after every general election, shall remove the name
 
 6 of any registered voter who did not vote in that general
 
 7 election, and also did not vote in the primary election preceding
 
 8 that general election, and also did not vote in the previous
 
 9 general election, and also did not vote in the primary election
 
10 preceding that general election, and also did not vote in the
 
11 regularly scheduled special elections held in conjunction with
 
12 those primary and general elections, if any, with the exception
 
13 of:
 
14      (1)  Those who submitted written requests for absentee
 
15           ballots as provided in section 15-4; [or]
 
16      (2)  Anyone who preregistered pursuant to section
 
17           11-12(b)[.]; or
 
18      (3)  Those who responded to the list maintenance processes
 
19           of subsection (b).
 
20 If a person voted, at least once, in any of the above-mentioned

 1 elections, the person's name shall remain on the list of
 
 2 registered voters.  For this purpose "vote" means the depositing
 
 3 of the ballot in the ballot box whether the ballot is blank or
 
 4 later rejected for any reason.  In the case of voting machines
 
 5 "vote" means the voter has activated the proper mechanism and fed
 
 6 the vote into the machine.
 
 7      (b)  The clerk shall [also] identify or remove the name of
 
 8 any registered voter, if [the]:
 
 9      (1)  The clerk, after mailing a notice or other
 
10           correspondence, properly addressed, with postage
 
11           prepaid, receives the notice or other correspondence as
 
12           return mail with a postal notation that the notice or
 
13           other correspondence was not deliverable[.]; and
 
14      (2)  The clerk after mailing a notice of removal, properly
 
15           addressed, with postage prepaid, receives the notice of
 
16           removal as return mail with a postal notation that the
 
17           notice of removal was not deliverable.
 
18      (c)  On election day, any person identified or removed shall
 
19 have the person's name corrected or restored in the register and
 
20 shall be allowed to vote if the person completes an affidavit or
 
21 other form prescribed by the chief election officer affirming
 
22 that the person: [claims]
 
23      (1)  Claims the person's legal residence at the address

 1           listed on the register; [changed]
 
 2      (2)  Changed the person's legal residence after the closing
 
 3           of the register for that election; or, [moved]
 
 4      (3)  Moved to a new residence within the same precinct as
 
 5           the person's residence as listed on the register.
 
 6 [(c)] (d) The clerk may remove the name of any registered voter,
 
 7 if the voter so desires and properly notifies the clerk pursuant
 
 8 to the procedures established by the chief election officer.
 
 9 [(d)] (e) Any person whose name has been removed from the
 
10 register, at any time prior to the closing of the register, as
 
11 provided in section 11-24, may have that person's name restored
 
12 in the register by presenting oneself to the clerk and
 
13 reregistering pursuant to section 11-15, or by making application
 
14 by mail or otherwise pursuant to procedures established by the
 
15 clerk.  The clerk shall require satisfactory evidence to
 
16 establish the identity of the applicant.  The names of all those
 
17 persons shall be reentered in the register."
 
18      SECTION 2.  Statutory material to be repealed is bracketed.
 
19 New statutory material is underscored.
 
20      SECTION 3.  This Act shall take effect upon its approval.
