                   A  BILL  FOR  AN  ACT

RELATING TO UNIVERSITY OF HAWAII REGENTS.


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 304-3, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§304-3 Regents; appointment; tenure; qualifications;
 
 4 meetings.  (a)  The affairs of the university shall be under the
 
 5 general management and control of the board of regents consisting
 
 6 of twelve members who shall be appointed and may be removed by
 
 7 the governor.  When appointing members of the board, the governor
 
 8 shall consult the University of Hawaii regents nominees
 
 9 evaluation commission which shall consist of seven members.  The
 
10 chairperson for the commission shall be selected by the president
 
11 of the senate.  For the six remaining commission members, one
 
12 member shall be selected by each of the following:  the board of
 
13 regents as it may from time to time be constituted; the
 
14 University of Hawaii Alumni Association; the University of Hawaii
 
15 Faculty Senate; the Research Corporation of the University of
 
16 Hawaii; the board of education; and the union representing the
 
17 faculty of the university.  Commission members shall serve at the
 
18 pleasure of their respective constituent bodies.  Commission
 
19 members shall serve without pay but shall be compensated for
 
20 reasonable expenses under procedures established by the senate.

 1      The governor shall submit the governor's nominess to the
 
 2 commission before submitting them to the senate for appointment.
 
 3 In evaluating the governor's nominees to the board of regents,
 
 4 the commission shall consider the following:  whether the nominee
 
 5 is unqualified, qualified, highly qualified, or most likely
 
 6 qualified for appointment in the majority view of the commission;
 
 7 the salient qualifications of the nominee; how the nominee would
 
 8 bring to the board such skills or capabilities that given the
 
 9 needs of the university, the existing skills and capabilities of
 
10 the board, and the skills and capabilities of other nominees, the
 
11 board as a whole would competently discharge its statutory
 
12 mission.  The commission shall submit a report to the governor
 
13 and to the senate on the commission's nominees.  The commission's
 
14 report shall be a matter of public record and shall be lodged
 
15 with the appropriate senate committee no later than its
 
16 deliberations on any appointments.
 
17      The commission shall evaluate repeat nominees on the same
 
18 basis as new nominees.  Upon request, the commission shall
 
19 provide the governor with its opinions on the fitness of
 
20 potential nominees.  The commission may conduct other
 
21 investigations or research relevant to the appointment of regents
 
22 as the senate may delegate.

 1      (b)  The term of each member of the board of regents shall
 
 2 be for [four] twelve years; provided that the term of the student
 
 3 member shall be for two years.  A member of the board may be
 
 4 reappointed once.  Except as otherwise provided by statute, state
 
 5 officers shall be eligible [to] for appointment and membership.
 
 6 Every member of the board may serve beyond the expiration date of
 
 7 the member's term of appointment until the member's successor has
 
 8 been appointed and has qualified.
 
 9      (c)  The board shall at its first meeting after June 30,
 
10 elect a chairperson and vice-chairperson, who shall serve until
 
11 adjournment of its first meeting after June 30 of the next year
 
12 or thereafter until their successors are appointed and have
 
13 qualified and whose election shall be immediately certified by
 
14 the board to the chief election officer.  The board shall appoint
 
15 a secretary, who shall not be a member of the board.  The
 
16 president of the university shall act as executive officer of the
 
17 board.  The board shall meet not less often than ten times
 
18 annually, and may from time to time meet in each of the counties
 
19 of Hawaii, Maui, and Kauai.
 
20      (d)  The members of the board of regents shall [serve
 
21 without pay but shall be entitled to their traveling expenses
 
22 within the State when attending meetings of the board or when
 
23 actually engaged in business relating to the work of the board.]
 
24 each receive compensation of $25,000 a year."

 1      SECTION 2.  Statutory material to be repealed is bracketed.
 
 2 New statutory material is underscored.
 
 3      SECTION 3.  This Act shall take effect upon its approval.
