REPORT TITLE:
Parking Citations


DESCRIPTION:
Expands to 60 days the time within which a rental or U-drive
lessor has to provide the court with the name and address of a
lessee receiving a parking citation.  Makes waiver of this

                   A  BILL  FOR  AN  ACT

RELATING TO PARKING CITATIONS. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 291C-168.5, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "[[]§291C-168.5[]]  Liability of lessee for parking
 
 4 citation.  Notwithstanding any other law to the contrary, if the
 
 5 registered owner of record is the lessor of a rental or U-drive
 
 6 motor vehicle, as defined in section 286-2 pursuant to a written
 
 7 lease agreement, the lessee at the time of the issuance of the
 
 8 parking citation shall be responsible for such summons or
 
 9 citation; provided[, however, said] that the lessor shall be
 
10 responsible for such summons or citation if the lessor does not
 
11 provide the court having jurisdiction over the summons or
 
12 citation the name and address [of the] provided by the lessee to
 
13 the lessor within [forty-five] sixty days after a notice
 
14 containing the date, time, and location of the violation and the
 
15 license number of the vehicle is sent to the lessor; provided
 
16 further that the administrative judge of the court having
 
17 jurisdiction over the citation or summons [may] shall waive the
 
18 requirement of providing the name and address of the lessee by
 
19 the lessor and impose an administrative fee of five dollars per

 1 citation on the lessor[.] if the lessor fails to provide the name
 
 2 and address of the lessee within sixty days following the receipt
 
 3 of notification of the summons or citation."
 
 4      SECTION 2.  Statutory material to be repealed is bracketed.
 
 5 New statutory material is underscored.
 
 6      SECTION 3.  This Act shall take effect upon its approval.
