                   A  BILL  FOR  AN  ACT

RELATING TO THE DEVELOPMENT OF A MULTI-PURPOSE SPORTS COMPLEX AND
   WORLD TRADE CENTER. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that the development of a
 
 2 multi-purpose sports complex and world trade center facility in
 
 3 Kapolei would enhance the State's economy by stimulating tourism
 
 4 and attracting new businesses to Hawaii.
 
 5      The legislature envisions a privately-built and operated
 
 6 sports complex that can accommodate all major sports, including
 
 7 track and field, soccer, baseball, football, basketball, and
 
 8 equestrian events.  A training facility within the sports complex
 
 9 would enable the State to attract world-class athletes with whom
 
10 local athletes could train.  A training facility would also allow
 
11 Hawaii to qualify for a professional sports franchise and attract
 
12 tourists wanting to attend professional sporting events.  A world
 
13 trade center facility would house new and developing businesses
 
14 in the Pacific Region and provide facilities for the expansion of
 
15 the computer technology and communication industries in the
 
16 State.  By establishing these activities within an enterprise
 
17 zone, qualified businesses would enjoy tax relief for up to seven
 
18 years.  Further, expansion of the State's recreational and
 
19 business activities in Kapolei would contribute to the growth of

 1 the State's second city and, thereby, help to alleviate traffic
 
 2 congestion on Oahu.      
 
 3      Under Act 328, SLH 1997, the legislature appropriated funds
 
 4 for the planning and construction of a State sports recreational
 
 5 complex on Oahu on a site to be selected by the Department of
 
 6 Accounting and General Services (DAGS).  The purpose of this Act
 
 7 is to require DAGS to select public lands in Kapolei as the site
 
 8 for a multi-purpose sports complex and world trade center
 
 9 building and to establish the area as an enterprise zone.
 
10      SECTION 2.  Section 209E-4, Hawaii Revised Statutes, is
 
11 amended to read as follows:
 
12      "§209E-4 Enterprise zone designation. (a)  The governing
 
13 body of any county may apply in writing to the department to have
 
14 an area declared to be an enterprise zone.  The application shall
 
15 include a description of the location of the area or areas in
 
16 question, and a general statement identifying proposed local
 
17 incentives to complement the state and any federal incentives.
 
18      (b)  The governor, upon the recommendation of the director,
 
19 shall approve the designation of up to six areas in each county
 
20 as enterprise zones for a period of twenty years.  Any such area
 
21 shall be located in one United States census tract or two or more
 
22 contiguous United States census tracts in accordance with the
 
23 most recent decennial United States Census.  The census tract or

 1 tracts within which each enterprise zone is located also shall
 
 2 meet at least one of the following criteria:
 
 3      (1)  Twenty-five per cent or more of the population have
 
 4           incomes below eighty per cent of the median family
 
 5           income of the county; or
 
 6      (2)  The unemployment rate is 1.5 times the state average.
 
 7      (c)  Notwithstanding subsection (b), census tract #405
 
 8 within the county of Kauai shall be eligible for designation as
 
 9 an enterprise zone.  The eligibility for designation shall remain
 
10 in effect until January 1, 1997, unless the governor earlier
 
11 determines that the eligibility is no longer necessary.
 
12      (d)  Notwithstanding subsection (b) or (c), only lands
 
13 classified as agricultural in the Waialua district on Oahu, as
 
14 defined in section 4-1(3)(D), shall be designated an enterprise
 
15 zone on July 1, 1997, and the designation shall remain in effect
 
16 until June 30, 2002.
 
17      (e)  Notwithstanding subsection (b), (c), or (d), lands in
 
18 Kapolei, Oahu, selected by the department of accounting and
 
19 general services as the site for a sports complex and world trade
 
20 center building under section 3 of Act   , Session Laws of Hawaii
 
21 2000, shall be designated an enterprise zone.  The designation
 
22 shall remain in effect until the governor determines that the
 
23 eligibility is no longer necessary."

 1      SECTION 3.  The department of accounting and general
 
 2 services shall select appropriate public lands in Kapolei, Oahu,
 
 3 not to exceed 3,000 acres, as the site for a multi-purpose sports
 
 4 complex which shall be constructed and operated by a private
 
 5 entity.  The designated public lands may also be used for the
 
 6 construction of a world trade center building.  In choosing a
 
 7 site, the department shall take into consideration the
 
 8 accessibility, size, and shape of the site, industrial and
 
 9 agricultural nuisances, infrastructure requirements, soil
 
10 suitability, weather, proximity to hotels or other housing,
 
11 interference with institutions or other public facilities,
 
12 promixity to commercial centers, aesthetic values, and other
 
13 relevant factors.
 
14      SECTION 4.  In printing this Act, the revisor of statutes
 
15 shall insert the number of this Act in the blank space following
 
16 the word Act in section 209E-4(e), Hawaii Revised Statutes.
 
17      SECTION 5.  New statutory material is underscored.
 
18      SECTION 6.  This Act shall take effect upon its approval.
