                     HOUSE  CONCURRENT
                        RESOLUTION
  PERTAINING TO MEDICAL USE OF CANNABIS.



 1        WHEREAS, a number of controlled chemical substances are
 2   used to provide relief from pain and to advance healing; and
 3   
 4        WHEREAS, these substances are controlled under state and
 5   federal laws by licensed practitioners to be issued to those
 6   who need relief from pain or the healing properties of these
 7   "controlled substances"; and
 8   
 9        WHEREAS, there has been significant research and evidence
10   that cannabis has provided many people with relief from a
11   variety of physical and mental conditions; and
12   
13        WHEREAS, there are a number of infirm people in this state
14   who can benefit from the physiological and mental effects of
15   cannabis; and
16   
17        WHEREAS, Hawaii state law provides a defense from
18   prosecution for the "ultimate user of dangerous, harmful, or
19   detrimental drugs pursuant to a lawful prescription"; and
20   
21        WHEREAS, Alaska, California, Oregon, Washington, Colorado,
22   and Arizona all have a similar "legal defense" built into their
23   current penal codes that allow for the cultivation, use, and
24   distribution of medical cannabis; and
25   
26        WHEREAS, this issue has received the attention of the
27   Hawaii Legislature during past and present sessions; and
28   
29        WHEREAS, the Governor of the State of Hawaii has endorsed
30   the legal use of cannabis for medical purposes; now, therefore,
31   
32        BE IT RESOLVED by the House of Representatives of the
33   Twentieth Legislature of the State of Hawaii, Regular Session
34   of 2000, the Senate concurring, that Hawaii state law does
35   allow for the legal cultivation, possession, transport, use,
36   and distribution of cannabis for medical purposes only under
37   the care and supervision of those individuals licensed in the
38   State of Hawaii to prescribe approved substances; and

 1        BE IT FURTHER RESOLVED that any cannabis eradication
 2   effort or program be adjusted to allow for the cultivation,
 3   transport, possession, and distribution of cannabis for medical
 4   purposes.
