                   A  BILL  FOR  AN  ACT

RELATING TO RECORDS.
 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that Act 311, Session Laws
 
 2 of Hawaii, 1998, raised the minimum fee to be charged for copying
 
 3 government records to 50 cents from 25 cents. The Legislative
 
 4 Reference Bureau issued a report, report no. 6, 1998 titled "The
 
 5 Price of Access:  Fees for Copies of State Administrative Agency
 
 6 Rules."  In it the bureau reported that a significant majority of
 
 7 agencies and programs did not want to charge fees for copies.
 
 8 Many of those agencies, however thought it reasonable and
 
 9 appropriate to charge the rate of 25 cents per page.  The purpose
 
10 of this Act is to return the minimum rate charged for copying
 
11 government records to 25 cents per page.
 
12      SECTION 2.  Section 92-21, Hawaii Revised Statutes, is
 
13 amended to read as follows:
 
14      "�92-21  Copies of records; other costs and fees.  Except as
 
15 otherwise provided by law, a copy of any government record,
 
16 including any map, plan, diagram, photograph, photostat, or
 
17 geographic information system digital data file, which is open to
 
18 the inspection of the public shall be furnished to any person
 
19 applying for the same by the public officer having charge or

 1 control thereof upon the payment of the reasonable cost of
 
 2 reproducing such copy.  The cost of reproducing any government 
 
 3 record, except geographic information system digital data, shall
 
 4 not be less than [50] 25 cents per page, sheet, or fraction
 
 5 thereof.  The cost of reproducing geographic information system
 
 6 digital data shall be in accordance with rules adopted by the
 
 7 agency having charge or control of that data.  Such reproduction
 
 8 cost shall include, but shall not be limited to, labor cost for
 
 9 search and actual time for reproducing, material cost, including
 
10 electricity cost, equipment cost, including rental cost, cost for
 
11 certification, and other related costs.  All fees shall be paid
 
12 in by the public officer receiving or collecting the same to the
 
13 state director of finance, the county director of finance, or to
 
14 the agency or department by which the officer is employed, as
 
15 government realizations; provided that fees collected by the
 
16 public utilities commission pursuant to this section shall be
 
17 deposited in the public utilities commission special fund
 
18 established under section 269-33." 
 
19      SECTION 3.  Statutory material to be repealed is bracketed.
 
20 New statutory material is underscored.
 
21      SECTION 4.  This Act shall take effect upon its approval.
