DESCRIPTION:
Raises the minimum wage to $5.75 and the tip credit to twenty-two
cents on January 1, 2001; requires application of the federal

                   A  BILL  FOR  AN  ACT

RELATING TO MINIMUM WAGE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 387-2, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§387-2 Minimum wages.  Except as provided in section 387-9
 
 4 and this section, every employer shall pay to each employee
 
 5 employed by the employer wages at the rate of not less than
 
 6 [$3.85 per hour beginning January 1, 1988, $4.75 per hour
 
 7 beginning April 1, 1992, and] $5.25 per hour beginning January 1,
 
 8 1993[.], and $5.75 per hour beginning January 1, 2001.  If the
 
 9 minimum wage prescribed by the federal Fair Labor Standards Act
 
10 is greater than the State's minimum wage, then the federal
 
11 minimum wage rate shall apply as the State's minimum wage.  The
 
12 hourly wage of a tipped employee may be deemed to be increased on
 
13 account of tips if the employee is paid not less than twenty
 
14 cents below the applicable minimum wage by the employee's
 
15 employer and the combined amount the employee receives from the
 
16 employee's employer and in tips is at least fifty cents more than
 
17 the applicable minimum wage.  Beginning January 1, 2001, the
 
18 hourly wage of a tipped employee may be deemed to be increased on
 
19 account of tips if the employee is paid not less than 22 cents

 1 below the applicable minimum wage by the employee's employer and
 
 2 the combined amount the employee receives from the employee's
 
 3 employer and in tips is at least 50 cents more than the
 
 4 applicable minimum wage."
 
 5      SECTION 2.  Statutory material to be repealed is bracketed.
 
 6 New statutory material is underscored.
 
 7      SECTION 3.  This Act shall take effect upon its approval.
