                   A  BILL  FOR  AN  ACT

RELATING TO EDUCATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 235, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "§235-      Income check-off authorized.  Notwithstanding
 
 5 any law to the contrary, any individual whose state income tax
 
 6 liability for any taxable year is $10 or more may designate $10
 
 7 for the liability to be paid over to the Hawaii educational
 
 8 computer technology fund, when submitting a state income tax
 
 9 return to the department of taxation.  In the case of a joint tax
 
10 return of a wife and husband having a state income tax liability
 
11 of $20 or more, each spouse may designate that $10 may be paid to
 
12 the fund.  The director of taxation shall revise the state income
 
13 tax form to allow the designation of contributions to the fund on
 
14 the face of the tax return and immediately above the signature
 
15 lines, or immediately above any similar designation.  An
 
16 explanation shall be included that clearly states that the check-
 
17 off does not constitute an additional liability.  If no
 
18 designation was made on the original tax return when filed, a
 
19 designation may be made by the individual on an amended return

 1 filed within twenty months and ten days after the due date for
 
 2 the original return for such taxable year.  A designation once
 
 3 made, whether by an original or amended return, may not be
 
 4 revoked."
 
 5      SECTION 2.  Chapter 302A, Hawaii Revised Statutes, is
 
 6 amended by adding a new section to be appropriately designated
 
 7 and to read as follows:
 
 8      "§302A-      Hawaii educational computer technology fund;
 
 9 creation of.  The Hawaii educational computer technology fund is
 
10 created as a trust fund within the state treasury.  The fund
 
11 shall consist of all moneys collected from persons who have
 
12 designated a portion of their income tax liability to the fund as
 
13 provided in section 235-    and any general fund revenues
 
14 appropriated.  The department of education shall develop
 
15 procedures by which schools may apply for these funds, which
 
16 shall be expended for the purpose of purchasing computers and
 
17 computer-related items, and for developing educational programs
 
18 utilizing computers and associated technology."
 
19      SECTION 3.  New statutory material is underscored.
 
20      SECTION 4.  This Act, upon its approval, shall apply to
 
21 taxable years beginning after December 31, 1999.
