DESCRIPTION:
Eliminates the annual motor vehicle inspection (safety check)
requirement for all vehicles except ambulances; trucks, truck-
tractors, semitrailers, and pole trailers having a gross vehicle
weight rating of more than 10,000 pounds; buses; rental or U-
drive motor vehicles one year of age or older; and taxicabs.

                     A BILL FOR AN ACT

RELATING TO PERIODIC MOTOR VEHICLE INSPECTION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:


 1      SECTION 1.  Section 286-25, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§286-25  Operation of a vehicle without a certificate of
 
 4 inspection.  Whoever operates, permits the operation of, causes
 
 5 to be operated, or parks [any] a specified vehicle on a public
 
 6 highway without a current official certificate of inspection,
 
 7 issued under section 286-26, shall be fined not more than $100[.]
 
 8 ;provided that this section shall not apply to automobiles or
 
 9 passenger vehicles, including motorcycles, trailers,
 
10 semitrailers, and pole trailers having a gross vehicle weight
 
11 rating of 10,000 pounds or less, and antique motor vehicles as
 
12 defined in section 249-1, except as required under section 286-
 
13 22."
 
14      SECTION 2.  Section 286-26(b), Hawaii Revised Statutes, is
 
15 repealed.
 
16      ["(b)  All other vehicles, including motorcycles, trailers,
 
17 semitrailers, and pole trailers having a gross vehicle weight
 
18 rating of 10,000 pounds or less, and antique motor vehicles as
 
19 defined in section 249-1, except those in subsections (c) and

 1 (d), shall be certified as provided in subsection (e) every
 
 2 twelve months."]
 
 3      SECTION 3.  Section 286-26, Hawaii Revised Statutes, is
 
 4 amended by amending subsection (d) to read as follows:
 
 5      "(d)  Every vehicle required to be certified under this
 
 6 section, shall be certified prior to the issuance of a temporary
 
 7 or permanent registration by the director of finance and prior to
 
 8 the transfer of any registration; provided that this requirement
 
 9 shall not apply to a subsequent transfer of registration in a
 
10 vehicle that carries a current certificate of inspection."
 
11      SECTION 4.  Statutory material to be repealed is bracketed.
 
12 New statutory material is underscored.
 
13      SECTION 5.  This Act shall take effect upon its approval.
